Court shut down twice in one day as Land League activists protest repossessions

There were over 150 applications for repossessions of homes up for decision today.

COURT PROCEEDINGS IN the Taoiseach’s home town were twice shut down today, as activists from the National Land League of Ireland and Integrity Ireland staged courtroom protests.

The NLLI said earlier it planned to stage the protest at Castlebar Courthouse after being made aware of over 150 applications for repossession of homes. The group – which offers support to families facing eviction – said its aim was to point out that the court proceedings were “not only morally wrong but also lawfully wrong”.

Speaking to TheJournal.ie by phone this evening, the NLLI’s Gerry O’Boyle – who ran under a land league banner in last October’s Roscommon-South Leitrim by-election – again insisted what was happening was “totally illegal”.

Registrar Fintan Murphy called proceedings to a halt this morning after a group of protesters staged an action in the courtroom itself.

O’Boyle said court business was then moved to a different room, where proceedings were held ‘in camera’. He said demonstrators had been calling for a “blanket adjournment”.

More cases were heard after lunch – but again protesters disrupted proceedings, and two men were removed from the premises by gardaí. O’Boyle said they were let off with a warning.

Independent TD for Tipperary South Mattie McGrath said in a statement he believed the decision to ban members of the public from the re-arranged court session was “an affront to the basic and fundamental right of access to the courts”.

“This is a continuation of the policy that I highlighted last October where people enduring the trauma of repossessions and evictions were denied the free and unhindered assistance of people who turn up to support them in their fight to retain the family home.

“Last year the Minister for Justice told me that where there were ‘credible threats to the organisation of courts’ and ‘major security threats’ in the administration of justice, such actions were permitted.

“Now I ask you, does the saying of the Rosary and peaceful objections to the legality of the proceedings constitute this kind of threat?” McGrath said.

“I am calling on the Taoiseach, not only as the head of Government, but also as the TD for that area to immediately assure us that when it comes to these kinds of sittings, access to the Courts will not become the exclusive preserve of the banks legal teams.”

    That’s is in a nutshell Kevin. There was so much misguided talk of debt forgiveness over the last year that you must wonder if some people decided to take their chances.
    Big difference between those people who simply cannot pay.

    Except in the case of buy to lets, the strategic defaulter hypothesis has been discredited.

    In the case of the family home , unemployment, reduced income, increased taxes and outgoings as well as mortgages which were unaffordable are cumulatively responsible.

    If you have proof or evidence to the contrary, the Central Bank of Ireland would like to hear from you.

    Theere will always be a small small minority that will try to take advantage of any given situation. Like in the case of gross hill. But they are the exception not the rule.

    When we are talking about a family living in a 2 or 3 bedroom semi that are probably not able to afford the mortgage any more, And more than likely should never given the size of mortgage to start with. Well then the banks need to take some responsibility. And either forgive some of the debt or come to a reasonable repayment.

    The vast majority of the people in mortgage distress are families who just wanted some basic shelter for their family.
    They attained this shelter with the assistance of what was supposed to be a highly regulated, highly stress tested off the shelf financial product (a mortgage) sold by highly paid highly regulated “experienced experts”.

    All of our banks criminally with their highly paid “experienced experts” criminally bust themselves and the entire country.
    It’s pathetic to even consider trying to blame the man in the street for any part of this act of financial genocide.

    Problem is and every town and village will have it. Some desided not to pay it at all. I know in my town alone where two men left their misses. Decided then f them in not paying for family home. Also then the cases where she might say in that situation that’s fine and she forces a sale or allows bank to reposses.the land league opposes these too. They get involved in domestic arguments.

    There is far more than meets the eye.

    Out of these 150 how many are families who lost jobs and really could not pay or even single people in same boat who GENUINELY could not pay and can provide records to show that. These are the ones that need help and protection. The chancers who I would say are the vast majority of repossessions today need no help from ff/land league.

    If you have a political issue with repossession, fine, run in an election. In fact, most of these figures have, and ddi can barely break 1000 votes.. Still, disrupting court rooms so you don’t have to pay back millions isn’t helping the people under any auspice

    Some links about Boi below. If the McDonalds lose Gorse Hill all bets are off and Ireland is the Wild West of banking. neither the parents or adult children owe BOI any money. The implications of this case law will mean no one is safe in their home. Try to see behind the spin. If a bank doesn’t need an original contract then anyone can lose their home. The banks are laughing all the way to court and never losing due to people willing to blame themselves, or each other. Where is bailout money. Some of the vulture funds don’t sell the homes just rent then and keep the money.     If im not mistaken the Land League was set up to protect poor tenants from unscrupulous Landlords not the “new” Land League they are headed up by a failed developer who owes millions himself and is a Fianna Fail activist that is a personal friend of one Bertie “no bank account” Ahern, their objective is to provide protection for people who live in Bog Standard palatial pads in Kiliney while 200 homes were repossessed in Limerick therefore they have no credibility!

    Where are the people they’ve helped? Where are the photos? the videos?
    Not sure if the Anti-Eviction-Taskforce are the same group of people, but at least they seem more active. That’s who I’d call if I needed help in barricading myself into my house.

    You’ll find its a separate group that chucked Gerry Beads and his cronies out on their arse. No affiliation to Gorse Hill. Being from Dundalk I know its origins and they are only interested in helping those in crisis who cannot pay, as opposed to the likes of McDonald who secured his businesses with personal liability after the banks would no longer lend capital to his companies.

    The are the National Land league as opposed to Gerry Beads land league. When they distanced themselves from the crowd defending Gorse Hill they really should have went for some rebranding. I know the crowd running it and the are hard working people who provide those in crisis with support and give free representation in court to those who cannot afford it as you can not avail of free legal aid when fighting a repossession. Feel free to correct me but that’s the facts as they stand to the best of my knowledge

    Not sure if your correct about not being able to avail of Legal Aid in relation to repossessions though. I don’t think it falls under any of the excluded categories (but I may be wrong too :) ) http://www.citizensinformation.ie/en/justice/legal_aid_and_advice/legal_aid_board.html

    Not sure myself to be honest, but I think that was why they were set up in the first place and then went on to help prevent repossessions. I’m sure one of our many legal geniuses on here will clear this right up.

    If you borrow money from somebody why should you have to pay it back? The simple solution is to chant can’t pay will not pay. People who lend money do not deserve to be paid back because they have plenty of money. Money can be obtained freely from those who are in possession of a money tree – just ask SF they have such an item.

    It is if you are facing losing your home it’s disgusting to tip toe around these lies of strategic defaulters no one with children would put them through the trauma have you been to an eviction? Where did the bail out money go? Some vulture funds are just making people default and renting the homes nothing put against loan they only paid a few hundred for anyway. Wake up

    @Tap you need to engage the brain here. In part I agree that if a person borrows money then they should pay it back. However in the case of the banks they never loaned any money because they had none. They created the amount in their ledgers based on their investments holding strong. When the investments collapsed they were paid in full by the Irish tax payer. So not only did the bank not lend money to these people but if they are tax payers then the bank actually owes them money.

    In a world where we all play fair I pay you what I owe you but in this world the banks and govt have screwed us and I don’t see why people should have to give up their homes to satisfy the banks particularly when most are actually offering the banks what they can afford. The prices on the houses were inflated by the banks not having any limits on what people can borrow so developers could put prices on houses of €500,000 when they cost €80,0000 to build. No sympathy for the establishment on this one.

    Fine GAel Bankster Buddies. Wasn’t it FG’s Alan Shatter who fixed it so it would be EASIER for banks to repossess !! Imagine….. As if it banks needed any more help from the Irish government. Shame on Alan Shatter and FG and bring on the election so we can rid ourselves of these vultures who are feeding off us. Lets elect someone who is a friend of the people not the banks

    And Coco it seems that debt forgiveness by the banks is almost exclusively for the big speculators, property developers, corporates, TD’s former TD’s etc etc, some of these enormous debt write offs could have written off thousands upon thousands of fairly minor mortgage arrears on family homes?.

    Not to mention the very same banks got a debt write off to the tune of €64 billion, all the while the Central Bank looked on as bank after bank speculated wildly and indulged in corrupt practices during the so call Celtic Tiger era.

    The class divide in Ireland continues unabated.

    Oggie its these same banks that got bailed out by the Irish people and ever since they have given nothing back in return, not implementing European interest rate deductions, refusing to lend money to the likes of SME’s, upping all their bank charges meanwhile clogging up the courts with repossession notices, many of these notices didn’t have to go before the courts but it seems the greedy banks have no interest in communicating with the borrower even if the borrower is making an effort to pay, just toss these faceless people in front of the courts and see what happens.

    The same bankers and government TD’s for that matter won’t be there when the Bailiff comes a knocking with a repossession execution to see the pain, anguish and the overwhelming despair that envelops the parents after receiving the repossession notice while the young children look on wondering what the hell is going on?.

    Faceless pawns to be dealt with by a stroke of a pen, while they look down from their Ivory Towers.

    People don’t have a right to live in a place that they borrowed money for and are no longer paying back. They council will provide them with a house on a means tested basis.

    The absolute reality is that only a very small percentage of repossessions are hardship cases.
    In some cases, people just believed Bertienomics and borrowed too much. You can’t blame the government for individual errors.

    The Land League are especially unlikeable as they represent the speculators who made the problem so much worse.

    Since you are so certain of the “absolute reality” please enlighten us as to your data sources. You need big back up for your proposition of fact.

    As for your opinion on the new Land League and its representation, I’m inclined to agree.

    I and many of my colleagues pro bono represent families in danger of losing their modest homes. In all cases, the recession and austerity measures have caused the genuine financial hardship, real hardship and real looming disaster.

    People would pay their mortgage if they could afford it. The link between mortgage arrears and Austerity is undeniable. The people who may be able to pay and wont are a minority . People see the broken laws of the financial industry and broken promises of the political elite “brown nosers” and think these jokers pay for nothing . That’s what people are thinking.     When Baldy Noonan was invited to, and went to gatherings of Vulture fund managers, what else can you expect. The banks waited until house prices were on the rise and only then did they move to repossess homes. And the government passed legislation to make it easy for them. The banks caused the problems in the first place, the taxpayer bailed out the banks. Now with government assistance and approval, the banks take advantage of people in difficulty. What a great little country to do corruption in.

    The Spanish Magistrates no longer grant possession orders, the police and fire services in Spain no longer cooperate with evictions and locksmiths refuse to change locks.

    The concept of community support and solidarity are more developed in Spain.

    The Courts and Magistrates in Spain are now nicknamed the “Robin Hood Courts”.

    It is extraordinary to read so many people baying for the banks to repossess family homes and who show no sympathy for distressed mortgagors or any understanding of the actual circumstances, the real circumstances, which have caused their financial problems.

    So many people support the Banks saved at a cost of more than €67 billion.

    The Banks created the problem. Now the banks seek to take advantage of the very problems that the Banks created.

    In point of fact banks dont loan money to people seeking mortagages they take the signature of the person seeking a mortagage and use this to create a primossory note this creates the money and this is the money that appears in their account, the bills of exchange of 1882 allows this to happen, so when the person who bought the house makes payments these are paid to the bank principal plus interest, the bank also sell the primossory on to a third party so they get double payment, the bank also take out insurance on the mortatge which they DiDnt loan and get paid three times and they get paid a fouth time through repoession so the bank get paid four times for a something which they never loaned out in the first place

    What needs to be highlighted and understood, is the vested and fraudulent interest the Registrar holds by being the SHERIFF for the county. He is paid a commission for EVERY property he repossesses.
    This is not just secluded to Mayo, it happens across the entire nation and it is FRAUD and WRONG.
    Check the video from Reality Ireland on youtube of what happened with the Gardai and their shutdown of constitutional right of access to the courts and justice, their refusal to prove the order issued preventing access, and their general dirty attitude to people in this incident.
