Runaway solicitor Michael Lynn arrested in Brazil

A warrant for his arrest was issued five years ago after the solicitor fled the country, leaving behind debts of over €80 million.

JUSTICE MINISTER Alan Shatter has indicated that the process by which Brazil – which Ireland has no formal extradition treaty with – agreed to arrest the solicitor Michael Lynn is one of “reciprocity” between the two countries.

The Minister was responding to news today that Lynn has been arrested by authorities in Brazil five years after fleeing Ireland and leaving behind debts of over €80 million.

In a statement this evening Shatter said he had been very concerned that the State was not in a position to pursue serious criminal charges “against an individual who had moved to Brazil”.

He said: “I have consistently made it clear that it is not acceptable that persons should seek to be immune from the consequences of their actions through evading court proceedings which they face in this jurisdiction.”

The Minister said he directed his Department to make arrangements to allow for the extraditions of persons from Brazil to face charges here with the result that the two countries are now to begin negotiations on a bilateral extradition treaty.

“Importantly, it has also been agreed that, pending the conclusion of the extradition treaty, the two countries would treat extradition requests from each other on the basis of reciprocity,” he said.

High Court warrant

As a result Lynn is now facing extradition proceedings but Shatter added that it would not be appropriate to comment any further now or if Lynn is extradited to Ireland to face charges.

Lynn was struck off the solicitors’ register in 2007, after the Law Society found that he had used money belonging to clients to fund his lifestyle and raised €80 million by securing multiple mortgages on the same properties.

Lynn failed to appear at the High Court in Dublin and a warrant was issued for his arrest but the fugitive solicitor moved through a number of European countries before heading to Brazil where he was granted permanent residency in 2011.

It is believed that the authorities here are seeking his extradition to Ireland and that an agreement was recently struck between the two countries. In an earlier statement today the Department of Justice said it does not comment on individual cases.

However, it said it should be noted that Ireland and Brazil agreed to commence negotiations on a bilateral extradition treaty.

“They have also agreed that, pending the conclusion of the extradition treaty, they would treat each other’s requests for extradition on the basis of reciprocity,” it added.

    For me he epitomised a lot of what was wrong in this country during the Celtic Tiger. In a 2009 interview he claimed he was an ordinary guy who got greedy during the boom as banks doled out money – and he wasn’t going to be a scapegoat – in my opinion, this is the arrogant response of someone who has no concept taking responsibility for their own actions.

    Very impressed by the authorities! Now if they would only arrest his wife Brid too. From her behaviour in the courts claiming monies from the sale of their Dublin mansion and her continued collusion with Michael Lynn, along with her “I’m a little victim” persona-surely she too should have questions to answer?!! You can guarantee she is the registered owner of any properties they have acquired in Brazil….oh yes, she has played a part in this too and has equally capitalised on Michaels millions. I really hope the courts go after BOTH of their assets in order to show some sort of justice in our legal system!!!

    Reciprocity? There must be someone here in custody wanted by the Brazilian authorities on a reciprocal basis, if so this should also be part of the news report.

    Glad he’s arrested, but would like to see that the legal case is watertight and doesn’t fall on technicalities around extradition grey areas.

    Even if by some miracle or other he was forced to come back here, the likelihood of him being convicted and jailed for a long period of time is very remote. Well connected fraudsters in Ireland generally don’t get punished!!

    Was it not the Banks who looked for Michael Lynn to be brought before the court to answer fraud charges relating to how he conned them out of mortgage money they loaned him. He had several mortgage approval on the same property from several banks. The high street banks were firing money at him without checking his applications out. Look what has happened in the intervening years to the general public. Extra money was fired at them from the banks but they could not run away like Michael Lynn. How many people have been let down by Lynn for properties that were never built but paid for in advance. I do not believe that Lynn will be extradited,how can he be if no extradition agreement exists.

    The department needs to get this one right and make sure all the facts are checked before bringing him back. If they f@@k this up its egg on the faces of all the Irish people. Take their time checking the facts and building a water tight case so he does time. Same for that dirt box in Boston.

    Remember these guys are the root cause I and some many others are now looking on from other counties. They all need to do time and we need to hold back until the case is so strong that this will happen. Last thing we need is a big fanfare and the images of these guys walking free from the high court.
