Nama and Ulster Bank block Sean Dunne's bid to dismiss bankruptcy

A BANKRUPTCY COURT in the US state of Connecticut has heard objections from Nama and Ulster Bank to Sean Dunne’s attempt to have his bankruptcy application dismissed.

The property developer applied last year for almost $1 billion in debt to be written off in the US, but last week reversed course.

Dunne’s lawyer James Berman asked the bankruptcy court to throw out the bankruptcy application, with the drawn-out and complex legal proceedings taking their toll on the Carlow man’s financial resources, RTE reports.

After launching his bid to have $942 million (€700 million) in debt thrown out, in March 2013, Dunne was subsequently declared bankrupt in Ireland after a case brought before the High Court by Ulster Bank, one of Dunne’s main creditors.

Yesterday, however, Judge Alan Shiff at the bankruptcy court in Hartford, Connecticut heard objections to Dunne’s bid to withdraw his bankruptcy application, from lawyers for Ulster Bank and Nama.

Furthermore, Richard Coan – the court official appointed to oversee the developer’s bankruptcy – told Shiff that he was also considering bringing proceedings against Dunne.

Coan’s lawyer, Timothy Miltenberger, told the court that Coan might launch a bid to recover some €40 million which Dunne transferred to his wife Gayle Killilea.

Judge Shiff will rule on 23 September as to whether Dunne’s case should be dismissed, or go to trail, the Irish Times reports.

    One of the main scourges of the tiger years. I remember the day after he bought Jurys for some stupid price (twice what anyone else was willing to pay) and he tried to justify it by saying people living in the commuter belt would pay a million each for an apartment in Dublin. I remember thinking, they move into the commuter belt because they couldn’t afford Dublin prices …….and then I began to wonder what brand of Ju-ju. Mr Dunne was smoking!

    He will still get away with it, even if they take money from him and his wife and even if they send him to jail for perjury..they doubtless have plenty squirreled away. Most robbers wear balaclavas and carry guns these wear couture and carry pens.

    Yea, you’d wonder who indeed is the biggest plank in this whole shambles; the borrower; the bank; the consultant who prepared the valuation on the POS properties funded 100% by borrowings; the consultant who prepared the financial projections forecasting the great idea; the banking regulator; the Central Bank of Ireland; the dept of finance; ECB; banks in Germany shovelling money into Ireland between 2002 and 2008 seeking higher yield.

    The whole effing mess started in Germany and Angela should sort it out, and pronto!

    Mr Dunne is but one player who was played – by the to55ers earning up-front commissions for shovelling out the confetti money – and willingly participated in the moronic game!

    I’m a little unclear on this.
    What should he be locked up for?
    Making stupid investments when the money was stupidly loaned to him by the banks?

    Fought NAMA tooth and nail to be declared bankrupt and now fighting them not to be declared bankrupt. The penny must’ve finally dropped that all his hidden millions in Swiss accounts can’t protect him from good old jail cell love, American style!!

    They treat white collar crime seriously in the States, unlike here. It’s a little clique here; but what can you expect in a country with a population a little over half the size of London?

    He will go to jail if found guilty in the states. In Ireland he would get community service. The people on welfare had their benefit cut to pay off the banks debts from this guy yet his sons behave like there is no end to their money. Richie Boucher probably didn’t chase these guys as much as the single mother struggling with her mortgage. The rich in Ireland and their banker friends get preferential treatment.

    It’s F…… Amazing the amount of effort Nama and the banks put in to recover assets from anyone who has them. It’s a pity the banks didn’t put the same amount of effort in the first place before they lent the money to anyone who could read. This country has learned noting it’s time the people stand together and take the country back from the losers who are trying to look like there doing a good job.
