PLAYBOY MAGAZINE IS suing an Irish website over an alleged copyright breach of photographs of Kate Moss.
The magazine claims entertainment.ie published a link to photos of Kate Moss “in various states of undress” which were to be featured in the magazines 60th anniversary edition the following week.
Playboy said the images featured the model “in various provocative poses and wearing the ‘Playboy bunny’ costume and in some of the photographs she is nude or semi-nude”.
Playboy Enterprises International Incorporated is taking an action in the High Court against Entertainment Media Limited – which runs entertainment.ie – seeking damages.
Playboy alleges that the action of the website caused significant loss and that entertainment.ie unlawfully published an entry entitled:
Save yourself a fiver. Here’s Kate Moss’ NSFW [not suitable for work] photos from Playboy” with a link to its website.
The link added: “It’s all about saving every penny at this time of year. Every little helps and what not.
So instead of having to wait for the latest 60th anniversary issue of Playboy featuring Kate Moss, we present to you Ms Moss in full below.
Playboy says it engaged two renowned fashion photographers, Mr Mert Alas and Mr Marcus Piggott to produce the exclusive images of the well known model for an eighteen page photographic spread.
However the magazine says the websites link to the photos a week before the edition was released “completely destroyed the exclusivity of the Kate Moss photoshoot”.
A preliminary pre-trial motion was heard at the High Court yesterday.
A spokesperson for Playboy told TheJournal.ie today: ”Playboy actively enforces rights to protect its valuable, copyrighted content. While we will not comment on specific actions, we can confirm that we are pursuing unauthorised republications of content from our 60th anniversary issue.”

To be honest I’d hardly recognise Kate Moss with clothes on…
hate to ask for some sort of journalistic digging, but who was hosting the photos? surely they are the guilty party?

Must be Rachel! Lot of debate around it, but it is an art form in it’s own right, and there is literally no limitations to how a beautiful woman can be photographed that way!

If you saw her tomorrow morn without the slap and the airbrushing and the spray tan , false eye lashes. Teeth whitening, false nails etc, you would pass her by as you would not recinise her with her grey smokers skin, greasy hair. Stick insect legs, you ouldent be so smitten.

You can’t sue someone for linking to content you host. That’s just how the internet works. If they didn’t want the images going public they shouldn’t have hosted them publicly on their site in the first place.

If the link they posted was to the playboy website and the images were freely available there I can’t imagine they’ll have much of a case. They should go after Playboy for costs too. Bit of free advertisement for entertainment.ie either way.
Yeah, maybe they won’t win. But when Heff drags you into the High Court, whether frivolous or no, you gotta defend yourself. I understand that you’d have very little out of €15k /day. In which case I’d be done in about 5 minutes… ;) Ould Hughie could probably stay quite a while longer!
