Graham Dwyer has lodged an appeal against his murder conviction

The jury found that Dwyer stabbed Elaine O’Hara to death for his own sexual gratification. He was given 21 days to appeal.

MURDERER GRAHAM DWYER lodged an appeal against his murder conviction.

The Foxrock architect and father of three was convicted of murdering childcare worker Elaine O’Hara in August 2012.

Her remains were found on Kilakee Mountain in Rathfarnham on 13 September 2013.

The jury found that Dwyer stabbed her to death for his own sexual gratification.

Life in prison

Justice Tony Hunt sentenced Dwyer to life in prison.

At sentencing, the judge gave Dwyer 21 days to formally appeal his conviction.

The grounds of the appeal are not yet known but it is believed that the charge of the jurors and the phone mast data may be used by his legal team.

Dwyer’s defence team applied for legal aid following his conviction, in case an appeal was lodged. This was granted.

Appeal 

The Court of Criminal Appeal would hear the appeal and it is suspected that it could be heard a lot sooner than the time usually taken.

The trial of Graham Dwyer lasted more than two months, with 197 witnesses and 320 exhibits.

Justice Tony Hunt said his life sentence is something Dwyer “richly deserves”.

He said no remorse of any kind was expressed by Dwyer and also mentioned the “bizarre spectacle” of Dwyer issuing a press statement following his conviction.

    So he’s looking for a technicality to get him out of prison.. you’d think he’d serve his time and let the people he has inflicted with misery get on with their lives including his own family.

    Unfortunately not, this is the problem with mandatory sentencing. If found guilty of murder you receive a mandatory life sentence, this cannot be reduced as part of a plea bargain and cannot be increased as a result of a failed appeals, so murder has the lowest rate of guilty pleas and very few convicted don’t exhaust the appeals processes because there is no incentive to ever accept your guilt or sentence.

    He was on a big salary so I’m not sure that he would have been entitled to legal aid from the outset. I could be wrong though

    Are you serious Andrea? I thought you had to be earning less than €18,000 a year at the time of arrest to qualify.

    I remember being very shocked at the time because of his profession, his wife’s and the fact that they lived in Foxrock. Somebody mentioned in the comments section that outgoings and existing debt are all factors in determining whether a person can avail of it. The whole system is bizarre to be honest. I have a vague recollection of Sean Fitzpatrick qualifying for it too. At this stage, I’m wondering if there is anyone out there actually paying their own legal costs.

    He was granted legal aid, when convicted there was a statement made that should he appeal, he could get legal aid then.

    How dare he appeal his conviction! It’s an insult to the memory of Elaine and to her family. He should be ashamed of himself. But I am to believe that a true psychopath does not feel the way normal people do. He genuinely terrifies me and he should never see the light of day again.

    Something not right about that case blunders by the judge were not challenged swiftness of the jury’s decision should cause concern
