DON’T WORRY – TDs aren’t off on their summer holidays just yet.

That won’t be happening for weeks.

It’s just a long (long) bank holiday weekend.

In fairness, it’s been a busy few weeks – what with last weekend’s referendum, and the progress of the Aer Lingus deal. Not to mention Averil Power’s Monday bombshell.

After catching their breath – TDs will be back on duty in just 11 days’ time … senators join them, in the upper house, slightly later the same afternoon.

Before we start getting angry phonecalls from Leinster House – we’d like to add that they’ll ALL be very busy with constituency work.

    Rte radio one now 10.00. Ff have written to ceann comhairle asking for the dail to be recalled regarding what happened with Catherine Murphy yesterday. Saying that media outlets being not allowed to report what she said as an attack on democracy. That TDs are being silenced on what they say in dail under privelige. That it’s a very worrying thing that a private individual is controlling what can be said in the dail. That the dail is a democracy and its free speech should not be attacked. If its allowed where will it stop. TDs should be allowed to speak without fear in the dail. What Catherine Murphy is doing is in the interest of the public interest. Its becoming a very wording trend that individuals can attack democracy like this and silence what is said in the dail. Waiting on a reply from the cc on whether the dail will be recalled.

    I’m asking everyone in Ireland to repost this article which was printed by Broadsheet last night. All of the Irish media have failed to report on Cathrine Murphy’s revelations about the dealing of Dennis O’Brien. He has gagged Irish media and RTE with his threats of court action. So it’s up to those of us with nothing to lose but more of an interest to print, copy tweet and post wherever we can! Please repost!
    Catherine Murphy, Independent TD for Kildare North, dropped a series of revelations in the Dáil today concerning alleged preferential treatment given to Denis O’Brien by IBRC, formerly Anglo Irish Bank.
    The claims emerged as Ms Murphy introduced a bill to permit the Comptroller and Auditor General to investigate the Siteserv sale and other IBRC transactions.

    “This bill extends the functions and powers, or seeks to extend the functions and powers of the C & AG [Comptroller and Auditor General] to cover IBRC. It was the Taoiseach that first suggested that the C & AG review the Siteserv sale’s process and it was then pointed out to him that IBRC does not come within his remit.”
    “With this Bill, I’m attempting to address that problem by broadening the remit of the C & AG. The reason I’m anticipating the need to involve the C & AG, if not a full Commission of Investigation, which may well be a better option, is because I believe the Government have got this badly wrong, not least because most of the key players in the Siteserv saga have links with KPMG and its eventual purchaser and vice versa, is a web of connections and conflicts, that requires outside eyes to unravel.
    I have no doubt that the special liquidator [Kieran Wallace] is more than capable of doing such a review but his direct involvement in the sale process, and his relationship with the eventual purchaser of Siteserv, and his current actions in the High Court, in supporting Mr O’Brien versus RTE, place him in a position where there is, at the very least, a perceived conflict of interest, if not an actual conflict of interest.
    The review is not confined to Siteserv but it is the transaction that prompted a review. I would worry about the transactions that have been excluded from the review, given that what we now know, that in the final months before prom night, the relationship between the department and IBRC had completely broken down.
    “If deals were being done without the knowledge or input of the minister then we need to know what they were. We are now aware for example that the former CEO of IBRC made verbal agreements with Denis O’Brien to allow him to extend the terms of his already expired loans.
    We also know that the verbal agreement was never escalated to the credit committee for approval. I’m led to believe, and I would welcome the minister clarifying, the rates applicable at this time, that the extension also attracted some extremely favourable interest terms.
    I understand that Mr O’Brien was enjoying a rate of around 1.25%, when IBRC, and arguably, when IBRC could, and arguably should have been charging 7.5%. We are talking about outstanding sums here that are upwards of €500million. The interest rate applied is not an insignificant issue for the public interest.
    We also know that Denis O’Brien felt confident enough, in his dealings with IBRC that he could write to Kieran Wallace, as the special liquidator and demand that the same favourable terms extended to him by way of a verbal agreement could be continued.
    We now have Kieran Wallace, who’s been appointed by the Government to conduct a review into the IBRC review, actually joining with IBRC and Denis O’Brien in the High Court and seeking to injunct the information I’ve outlined from coming into the public domain – surely that alone represents a conflict.
    In FOI documents released to me, the minister, his officials and the Central Bank and even the Troika acknowledge that IBRC, the former Anglo Irish Bank, is no ordinary bank and there’s a significant public interest because the bank had been fully nationalised and was in wind-down mode.
    They all accept that this is the people’s money that we’re dealing with and that there can be no dispute regarding the public interest in this. The same FOI materials detail incidences where the minister can specifically intervene, and issue an ministerial order that material matters have significant interest. Included in these material matters are incidences that are outside the ordinary course of business.
    I would argue that what I’ve outlined out here regarding verbal deals, extensions, etc, are outside the normal course of business and I would ask the minister to exercise his right to intervene in the current proceedings and defend the public interest.
    “I’ve a motion on the order papers, signed by the majority of the Opposition – 45 members have signed it and more are welcome to – calling for a debate into the proposed review. When I tried to raise it on the order of business, I was silenced and I was told to take it up with my Whip. I am the Whip of the Technical Group and I did raise it at the weekly Whip’s meeting.
    The Government Chief Whip told me that they would not be altering the KPMG review, the Government would not be giving time to debate this issue and suggested that we use Private Members’ time.
    It’s not just an Opposition issue, minister. This is an issue for all in this house. It’s an issue of serious public concern where there is public money involved and I know, if you got your hands on maybe and extra €20million, I don’t think you’d have to think too hard on how to spend that money. I urge the Government to reconsider this and give the Bill and the motion the time they deserve. I believe this is in the public interest. Thank you.”

    Yesterday: Deputy Murphy is Out of order
    Scary update: Solicitors acting for Denis O’Brien have asked us to remove this post asserting that it is a breach of a High Court Order [O’Brien Vs RTÉ]. They gave a 7pm deadline or they would begin injunction proceedings. We have replied that article 15.12 of the constitution allows all Dáil statements “wherever published” to be privileged and we currently await their response.
    Update: In response, Denis O’Brien’s legal representative said the High Court ruling “covers what could be reported about what was said in the Dáil by Catherine Murphy” and again put us ‘on notice’. Unfortunately The judge in the case never revealed the terms of the injunction. In a statement tonight Catherine Murphy said: “I am a public representative. Information came to me, from a number of reliable sources, that is, without doubt, in the public interest. I have a duty to put that information into the public domain and I fully intend to fulfill my democratic mandate.”

    One day of leaders questions last week, Dail business turned upside down to revolve around the Aer Lingus sale calamity, now this. Public representatives should have been asking the tough questions about siteserv this past fortnight, but instead Claudius runs back to hide behind the curtain while the puppet master fires out solicitors letters at anybody who dares to lift the lid on the slurrypit of IBRC.

    Article 15.12 of the constitution states:

    “All official reports and publications of the Oireachtas or
    of either House thereof, or of a committee established
    by either or both such Houses, and utterances made in
    either House or in a committee appointed by either or
    both Houses wherever published shall be privileged.
    The members of each House shall not, in respect of any
    utterance in either House or in a committee appointed
    by either or both Houses be amenable to any court or
    any authority other than the House of which the person
    concerned is a member.”

    so my understanding is that Ms. Murphy was 100% entitled to say what she said.
    whats not clear is whether or not media are necessarily allowed to report on what she said, despite it already being out there.

    you have to have some b*lls to challenge the constitution though, which it appears is being done here.

    (non-controlled) media outlets should have more courage though

    @ Miguel: The relevant bit is the following….

    “… and utterances made in either House or in a committee appointed by either or both Houses WHEREVER PUBLISHED shall be privileged.”

    In laymans terms, the media publishing what a member of the Dail says under privilege is allowed, because they are merely repeating in print something covered by that privilege. This is the article under which broadsheet.ie told DOBs solicitors to do one….

    11 days to keep ms murphy quiet. that should do it, she has enda on the run this story is not dying the death it was meant to. over the last few weeks there has been a high proportion of stories on the referendum sometimes 3-4 articles in the one day, i have never seen that before on any referendum, of coarse we also had a story yesterday on the banking enquiry and labours hard hitting questions on golf balls wow the mind boggles, it will be back to iw again anything to distract from siteserve well it looks like its not working out as they hoped as we the people will use our freedom of speech while we have it because if labour get their bill through we will be looking at section 31 again, funny that as labour were the ones who abolished it.

    What a laugh. Then they tell us other countries have dictators. Even TDs are trying to be silenced . what now , they don’t want to let the people hear what was said in our national parliament by elected TDs. It is showing without a doubt that someone does not want this information out and will pull out all the stops to try and make it happen. If you have nothing to hide then why all the silence tactics.     Sure even when they’re in the Dáil the media doesn’t cover what was said so maybe they’re thinking ‘what’s the point’?
    It’s a sad day when the entirety of the Irish media bends the knee to a wealthy private citizen out of fear of being sued even though they would probably win the case as Dáíl proceedings are subject to privilege.

    HHDOB is not a private citizen he is in fact according to the Revenue and himself, a foreign / tax exile businessman with extensive business interests in Ireland. I on the other hand am a private citizen as I reside here and am a tax-complient taxpayer.

    Just for melancholy, this was a comment made yesterday

In return for Denis O’Brien’s vomitously illegal inducements, Lowry gave Denis O’Brien billion euro mobile phone provision contracts for a few million euros.Hilarious no Denis O’Brien ripped us all off.And not just by bribing Mick Lowry to scam the exchequer either.
    As proprietor of Independent Newspapers Denis O’Brien has also corruptly benefitted from the, er, largesse of the present Fine Gael Labour government.
    That is to say when Independent Newspapers refused to pay its bank debts to Allied Irish Banks causing Allied Irish Banks to collapse, Fine Gael using public money, purchased the now worthless Allied Irish Banks for the bargain basement price of ten thousand million dollars, and then promptly cancelled Independent Newspapers debts.
    Now that’s what I call the ultimate white collar crime.
    That and Fine Gael ensuring Denis O’Brien still hasn’t faced charges for bribing Lowry, in spite of a Judicial Investigation making it crystal clear the Denis O’Brien should face those charges.
    You will note gentle travellers of the internet that the Irish Independent prints a photograph of Fine Gael Enda Kenny every day.

    Hate to agree with the bould Lucinda – but we can all see why giving away any control of our national airline had to be rushed through the Dail in 2 days – theres some fierce urgent potholes that need to be addressed in the constituencies. Never mind that we’re now at the mercy of Willie Walsh and British Airways Inc with their plans for Aer Lingus and their Heathrow slots. Sure they’re grand now for 7 years! Willie will look after us – my arse – but all of our idiot TDs had to get the vote of the way to get back to their vital constituency work. How many of them will actually be available to their constituents between now and the 9th June?

    Can’t comment on the piece on Catherine Murphy v Denis o Brien so I’ll comment here. What Denis doesn’t understand is that he only owns the elected government NOT the Dail, at lest not yet. So well done Catherine, keep up the good work of doing your job as an independent TD.
    If we look at Labour and unfortunately the whole system of big parties , our TDs seem to have no power what so ever. just what are they for? Yes men to the party whip. Surely this is not right. My local TD that we elected almost 5 years ago has done nothing but toe the line, what is the point in electing all the TD ??? We might as well but a dozen people into the dail and let them rule and safe some much needed money

    I’m sure all these issues will be history after the coming general election. We’ve so many wonderful candidates waiting in the wings to bring in the utopia we deserve.
    It’s up to all who are interested to vote carefully when the time comes.
    No income tax, minimum wage €50 an hour, no water charges, no vat, free flights on Aer Lingus,
    free Medicare for all, etc etc.
    Looking forward to the ‘new’ Ireland.
