Someone's launched a (very) last minute challenge against same-sex marriage

Gerry Walshe, an electrician from Clare, wants a judicial review.

A FRESH LEGAL challenge is to be brought against the result of the same-sex marriage referendum.

The latest challenge has been brought by Gerry Walshe, an electrician, of Lisdeen, Co Clare.

The Supreme Court last week refused to permit separate legal actions brought by both Walshe and Maurice Lyons, from Callan, Co Kilkenny, to bring further appeals against the rejection of their challenges to the Yes result of the same-sex marriage referendum.

The court said:

“It would not be necessary in the interests of justice that there be an appeal to the Supreme Court.”

However in a new application, to be made before the duty Judge at tomorrow’s vacation sitting of the Court, Walshe will ask the High Court for permission to bring proceedings against the State by way of judicial review.

Referendum

The latest action is understood to relate to the decision by the State to issue and sign the final referendum certificate in August although a challenge (namely Walsh’s legal action which was ultimately dismissed by the Supreme Court) against the result was still in being.

The bill formally allowing same-sex couples to marry will pass through the Dail and Seanad over the coming days and weeks.

In its decision last week the Supreme Court ruled neither Mr Walshe nor Mr Lyons had met the requirements for a Supreme Court appeal as neither had raised the necessary legal point of general public importance, had raised no points “of substance” and the interests of justice did not require they be given permission to appeal.

It also noted that because no stay had been placed on the certificate of the referendum result after the Court of Appeal decision, “very serious constitutional consequences” might have occurred had it decided to grant leave to appeal.

It said both men, who represented themselves, had sought in separate actions initiated on June 2nd to challenge a provisional referendum certificate.

Dismissed

The High Court dismissed their proceedings on June 5th.

The Court of Appeal upheld that decision on July 30th when it dismissed both appeals against the High Court refusal and also lifted the stay on the issuing of final referendum certificate.

The men sought to have their appeals heard by the Supreme Court.

    Could you imagine, just for giggles I’m not saying I advocate anyone doing such things (but if they did, I’d pay to see the video) if gay couples quietly moved in all around Gerry Walshe and then suddenly surprised him with a ‘coming out’.     Two gay men raising children where one is the biological father. Two gay women raising children where on is the biological mother. That would account for 99.9% of gay headed families. You have no problem with single parents where one parent is not involved and have never campaigned for those children to be taken from their single parent. You have campaigned to have the children of gay parents to be taken from them.
    Exactly what part of that has nothing to do with gay people?

    As far as I’m concerned if anyone is going to make dramatic claims then they have to be able to back them up with equally dramatic evidence. The argument that children raised by same sex parents do just as well as children raised by opposite sex parents has been studied, proven and published in respected peer reviewed journals. That case is closed. There is no argument.
    If someone were to counter this argument they’d have to produce some really amazing evidence, it would have to be something really groundbreaking and published , again, in peer reviewed journals. As no such evidence exists the point is moot.

    Seems to be the flavour of the month.
    Random sampling is the gold standard of social scientific studies. The ACHESS study used the snowballing technique where motivated friends asked their friends to participate in a study in which the participants knew the primary questions up front,
    Many people signed up for political reasons. There was a social desirability bias.
    No peer review either contrary to current belief.

    The children come from all states and territories in Australia, with the exception of the Northern
    Territory. But they are all friends and flew from every party of Australia for playdates and to chat about primary questions every second day lol. Come on Tommy make a better attempt than that.

    Many people signed up for political reasons. There was a social desirability bias.
    Gay families signed up for a study on gay parenting so that makes it bias. lol Maybe he should have had straight couples to do the study on gay parenting. Even Tony wouldn’t come out with something that stupid lol
    So the lead author is gay on this particular study. so what ? It’s not like he’s not qualified or anything.

    There is some evidence to suggest as much. In a 1993 study, levels of homophobia were assessed among 64 men along with their sexual arousal (measured by increases in penile circumference) in response to erotic videos of heterosexual, same-sex female, and same-sex male encounters. Those who scored high on homophobia were more likely to also manifest sexual arousal in response to the videos of male homosexual encounters.* In a more recent study it was found that men raised in authoritative households were more likely to repress same-sex attractions and to exhibit more hostility to gay people.
    Emile Griffith, a recently deceased welterweight and middleweight champion, pummeled an opponent to death after he had called him an anti-gay slur, Griffith continuing to punch him in the head well after he had clearly won the fight. Though he denied he was gay or bisexual at that time, later in his life Griffith admitted to having had affairs with several men including a male partner who cared for him up until his death.

    Yes James. I’ve seen studies of this type. Seems valid enough if a guy is terrified of being gay, which is often the case with rabid haters who are sprinkled liberally through history. Of course some people just want to vent their frustration (no pun intended) on someone or something. Maybe it comes under the heading of ‘Phobia’ an irrational fear of something unlikely to harm you.     Anybody can appeal the referendum decision . They are or arguing they are acting in the public interest. They will not be charged.

    It’s nothing to do with unintended consquenses, these cases are NOTHING to do with SSM or the implications of it (it would be lunacy if people could challenge on those grounds when the people already made their decision – it was insane to put this kind of thing to a vote at all) it’s all technicalities about how it was rolled out etc, the last cranks for example tried to argue that people who did not vote should be considered no voters.

    The appeal relates to the government issuing and signing the referendum certificate although the Supreme Court hadn’t delivered its final ruling on Walsh’s legal action. The majority can only speak within a particular legal framework. The government and many pro-SSM activists believe this issue is more important than any other constitutional issue and therefore don’t have to bothered with playing by the rules. Well they do, so it’s going to take a little longer to get what you’re looking for.

    Atlantic Philanthropies funding ended in 2013. Every penny was accounted for. All donations to YesEquality were made by Irish citizens only (I know, because I campaigned and canvassed for the Yes vote but I was not allowed to donate because I hold a British passport! ). NOM was asking it’s followers to support the NO campaign less than a month before the referendum.

    The Supreme Court was not asked to issue a Stay. That is what the Judge is referring to. If Mr Walshe was serious he could have asked for a Stay, instead he didn’t which allowed the Government to move ahead with introducing the Bill.

    We are lucky to live in a society where people are not refusing to issue same sex marriage licenses playing the religious card, and who respects the law of the land, challenging the law with the Supreme Court like in this case. I disagree with Mr. Walshe, but he is entitled as a citizen to challenge the law, we have the means to do that without reoccurring to extreme outdated measures like in the US, for that I respect Mr. Walshe and everyone who feels strongly against Same Sex Marriage but wants to challenge the law in a civilized way.

    I’ve gone through various emotions regarding all these appeals we see cropping up here.. now I’ve just come to the conclusion that beyond having such a bigoted fascination with what 2 people you don’t even know are doing, it is all the more bizarre to try to keep our little island same sex marriage free. What do most of the most Catholic countries in the world now have in common? Marriage equality. There are too many far more important things going on to so persistently bang on about this whatever about calling into question the democratic will of our majority.

    What benefit can possibly result from a legally baseless challenge to a very clear and decisive Referendum outcome?

    This is unbelievable. I thought this was finished with after the Supreme Court ruling last week.

    Seems Gerry Walshe simply can’t let it go. Clearly he does not like the result of the referendum, but thats democracy.

    Im sorry Gerry, but you’re wasting your time and money – clearly you’re a man of means when you’ve gone to the Supreme Court with it.

    I agree, James – the referendum caused a lot of anguish and grief to my LGBT family and friends when people like Breda O’Brien, David Quinn and Rónán Mullen were actively denigrating them and their lives and families. My friends had to knock on thousands of doors, cap in hand, asking the people of Ireland to vote on a fundamental right to marry and were very aware that on the 22nd May 2015 they might have become second-class citizens in their own country. The lives of the LGBT community were torn apart in the public forums and so yes, I was and am still concerned that a plonker like Gerry Walsh is STILL trying to negate such a decisive vote for a fair and equal Ireland

    Ok guys, ignoring that big argument that’s happening right now, here are the facts: A movie was made about accepting same-sex families in society. Yer one, the Australian lad, bans them from being watched in school. Why, exactly? Because he is homophobic. Now now, before I get a tsunami of angry replies, read on. There was no need to ban the movie. Because school kids don’t watch movies during school hours anyway. And assuming their teacher does let them watch one once in a while, why not that one? It’s not like the teachers are going to go out of their way to make the children watch this movie because it has gay/lesbian couples in it. So there is no need to ban it. See where I’m coming from?

    He should know that referendum challenges are always thrown out by the courts – if he looked at the failed challenges to the relatively recent Childrens’ Referendum, and the divorce one in 1995. Both of those were passed also, the Divorce one albeit very narrowly. Yet challenges to both were rejected in the Courts.

    How on earth does he think he has a chance with a challenge to the Marriage Equality Referendum, given its clear 62% majority….?
