Garda killer Pearse McAuley back in jail for Christmas Eve knife attack on estranged wife

The former Sinn Féin councillor Pauline Tully was treated for serious stab wounds in hospital on Christmas Day.

CONVICTED GARDA KILLER and former IRA man Pearse McAuley has been given a 12-year prison sentence for assault causing serious harm to his ex-wife, local school teacher Pauline Tully last Christmas Eve.

The Strabane-native (51) with an address at Canal Bank Walk, Ballyconnell, had pleaded guilty to falsely imprisoning Ms Tully, and intentionally or recklessly causing serious harm to her at Keelderry, Kilnaleck on 24 December last year.

He also pleaded guilty to production of a knife, and to threatening to kill her brother during the same incident.

Before Judge John Aylmer at Cavan Circuit Court this afternoon, McAuley was sentenced to serve 12-years imprisonment for assault causing serious harm to Ms Tully, a former Sinn Féin county councillor, with four years suspended and his term backdated to time he first went behind bars.

He was also sentenced to serve three-years for production of a knife, six for false imprisonment, and four for the charge relating to making a threat to kill.

Upon release, McAuley will enter into a four-year bond of supervision by the probationary services.

McAuley spoke only once throughout the sentencing hearing, to acknowledge that he understood the terms when signing the bond of €100.

Recognisances were fixed in the event of an appeal.

Last week Ms Tully gave evidence by way of victim impact statement, saying that she dreaded and feared the day her estranged husband would be released.

I am in absolute fear of him and fear that someday he will make another attempt on my life. I do not ever expect to enjoy a peaceful mind, but will live a life haunted by what happened to me.

McAuley, a former IRA man, spent 10 and a half years in prison for the manslaughter of Jerry McCabe. The garda was killed during an attempted robbery in Adare, county Limerick in June 1996.

Initial charges of murder against him and three others were dropped after witnesses refused to testify for fear of the IRA.

McAuley was released from prison in 2009.

However, he had been granted temporary release in January 2003 so he could marry Pauline Tully. The ceremony took place in her hometown of Kilnaleck.

    gerry lobbied hard to these garda killers to be released. he initially made it a part of demands for their powersharing in the north. a cursory Google search will help you with your query

    For what it’s worth, it wasn’t a SF demand that they be released “for powersharing”. Powersharing was in place a year before before those men were jailed.

    The campaign for their release was due to the fact that they qualified for early release under the terms of the GFA, which was agreed by both governments, and the people of the whole country. So whether or not you liked their early release, if you voted ‘yes’ to the Good Friday Agreement, you were agreeing to the early release of all paramilitary prisoners who qualified for it, including these men. You cannot pick and choose which parts could be enacted and which couldn’t.

    To be fair, there were dozens of prisoners early released to secure the peace which this country badly needed. Many of them turned over a new leaf and continued on with there lives and became decent citizens. Whatever about the crimes of others after the peace agreement was signed, they should have been returned to prison to serve out their sentences without remission.
    Pauline Tully is a good person, a teacher who served on Cavan County Council as a Sinn Fein councillor. She knew what she was doing in marrying Pearse McCauley, tried to make him see better ways but unfortunately that wasn’t to be.

    Oisin, soundbites aside, the fact remains that legally, they qualified for early release under the terms of a treaty ratified by the people. If you voted for the Agreement, you voted for their early release. That’s how it works.

    An article relating to supplementary talks? Bravo. The men were jailed in 1999. SF had already signed up to the powersharing arrangements a year previously. So to suggest that SF were pressing for their release as a bargaining chip for powersharing is nonsensical. Not to mention the fact that they weren’t released until 11 years into powersharing ffs.

    What a disgrace ! What does this man have to do to be taken off the streets for good. He has murdered, shot at prison guards, tried to kill his wife in front of their children , And that’s only what he was caught doing ! FFS… The poor kids will have nightmares a lot longer than his sentence !

    In your honest opinion Tir SHOULD they have qualified? The robbery they committed and cowardly shooting of both Gardai in the back was not part of the IRA campaign to free Ireland. Of all the actions they carried out over the years I don’t think this one falls into the category of their struggle. I know you’re a hard line republican but surely you can find it in yourself to condemn this particular act as wrong. This man is a killer. Many former IRA members may well have embraced peace. But this man is obviously still very very dangerous. With such violent tendencies that he has now displayed again I really think this sentence is very lenient. There is a strong possibility that he will commit extreme violence again upon his release. He will still be young enough. Forgetting political tendencies for a moment, do you not agree? His ex and children will be living in fear as soon as he gets out.

    Oisin that’s fair enough however 95% of the electorate of the Republic voted for the Good Friday agreement which covered the killing of Gerry McCabe. What that 95% don’t like to be reminded of is that they voted for the early release of people convicted of terrorist offences. What they also don’t want to be reminded of is the hypocritical attitude of the electorate in the republic who kept the killers of Irish police officers in jail while the killers RUC officers were allowed to walk free.

    This was a major bone of contention with Unionists and still is as they see the electorate in the Republic having double standards. People love to have a go at Sinn Fein for trying to get an early release for the killers but they don’t want to be reminded that it was the 95% of people who voted for the GFA that authorized their release in the first place.

    He wasn’t released under the GFA. The high court said he wasn’t eligible. He served his full sentence which was short because he was convicted of manslaughter instead of murder due to witness intimidation. All the while Adams and his party were kicking up a stink that he should have been out after 2 years.

    Brian, you’re forgetting that it was witness intimidation that got the charges dropped to manslaughter and made these animals eligible for gfa. Initially when the murder occurred gerry and co said it was an unauthorised attack and we’re at pains to distance themselves from the terrorists. once the charges changed, gerry and friends embraced them with almost brotherly concern and started looking for special privileges. what a difference a charge makes.

    Clumhain I’m not forgetting anything about the crime. Initially it was claimed that it wasn’t ordered from higher up and then it was claimed that it came from local level. They were in breach of General Order 8 (1) and (2) of the Green Book so the PIRA could have thrown them to the wolves but because of the GFA if SF were seen to hold back on this crime it could have meant that others would also be held back. Their being held for the full term was a political one and if you ask any Unionist they will tell you that there is one law foe the police in the republic and one for the police in the North.

Personally I would have done them for Capital murder and given them 40 years with no parole but that is not what the people of Ireland both North and South signed up for.

    Oisin it basically broke down to the fact that if they didn’t campaign for them then they would have faced a backlash from their support base. More to the point though is the fact that these weren’t the only prisoners covered under the GFA and if the Shinners left them there then you can be sure that there would have been objections to every other case due for early release. If they didn’t push for that part of the GFA then they would have been seen as weak and then other parts of the GFA would have been at risk.Remember it was the people, North and South, who voted for the GFA and it was up to the parties on all sides to see that the wishes of the people were implemented even if it rankled at times.

    The early release program also extended to Loyalist prisoners as well and is still in effect. If for instance soldiers were convicted of murder on Bloody Sunday they would only serve 2 years but you can be sure that the people will give out about that as well.

    The article that I posted highlights the case of Michael Caherer who received 25 years for the attempted murder of an RUC man in 1997 yet he was released in 2000 under the terms of the GFA. How can people in the Republic not compare the treatment of this case with McCabe’s case? There is a hypocrisy at the very root of people calling for early release of RUC killers and not of Garda killers and then not accepting that it was the people of the Republic who voted (all 1,442,583 of them) for that early release. It was there is black and white but I guess as usual people didn’t bother to read it.

    Gerry McCabe was nor killed for political reasons , he was killed by people who were robbing a post-office for personal gains . As the xumbags had connections high up in Sinn-Fein they got that party to swing there release as part of the GF agreement. The shite going on today in South Armagh is no different once Sinn Fein get a few bucks at the end nobody gives a fkuc.

    David, it is no crime to become a county councillor. Pauline Tully was elected to serve her Cavan constituents and they bore her no malice over her choice of partner to father her children.

    I expected 14 years none suspended presuming he has being in custody since his arrests he will be back on the streets in December 2020 probably long before that with temporary release and early release schemes that exist today,my sympathy for the victim is slightly tempered by the fact she married him while he was serving the manslaughter sentence so she knew and agreed with all his IRA activities prior to their marriage.

    Odd thing about this from a political point of view is that even though it should, it probably won’t make a difference to SF in the polls. Politics is so fecked in Ireland that come election day they will still make gains.It says a lot about the “traditional” parties that given a choice between SF and themselves a huge chunk of voters will vote the former.
