Boy (9) awarded €11,595 after claiming one-kilo dumbbell fell on his head in Dunnes Stores

The court heard the incident happened five years ago when the boy was four years old.

A NINE-YEAR-OLD schoolboy, who claimed a one-kilo dumbbell fell on his head in a Dunnes store five years ago, has been awarded €11,595 damages in the Circuit Civil Court.

Barrister Tracy Ennis Faherty told the court that Yug Bhansali was only four years old when the incident happened in January 2011 at Dunnes Stores in Blanchardstown, Dublin.

Ennis Faherty said the vinyl dumbbell weighed at least a kilo and had fallen off a shelf in the clothing department in the store. Yug had immediately felt pain to his head and had been very upset.

She told Circuit Court President Mr Justice Raymond Groarke that Yug had later needed to attend his GP after complaining of headaches. A CT scan had not revealed any trauma to Yug’s head.

Through his father Pallav Bhansali, of Hazelhatch Park, Celbridge, Co Kildare, Yug sued Dunnes Stores for negligence.

He claimed the store had failed in its duty of reasonable care by allowing the dumbbell, “a dangerous item of weight,” to fall on his son’s head.

Ennis Faherty said the defendant had made a €11,595 settlement offer which she recommended to the court. She said that liability would be an issue if the case proceeded to a full hearing.

Judge Groarke, approving the offer, said he was satisfied that it was a very good one that he could not refuse.

This government seems to have no problem passing laws that have great potential to expose citizens to danger and deny them rights, but when it comes to introducing laws to enhance citizens’ accessibility to social goods, such as housing etc, they find any amount of barriers to use as excuses to do nothing.

@McMahon G: Forty million Canadians wouldn’t agree. I see it as a basic right that people are entitled to ask for. Who would want to suffer needlessly? We wouldn’t do it to a pet.

Funny how evertime ffg are presented with a situation that will clash with Catholic ethos, They deflect and kick the issue down the road. This is cowardice of the highest kind and something a person who claims to be capable enough to represent citizens , Should never do, thats if they had an once of integrity.
