17 people injured in shooting at Arkansas nightclub

Police don’t believe the incident was terrorism-related.

POLICE IN ARKANSAS are investigating a shooting at a nightclub that left at least 17 people injured.

Little Rock police chief Kenton Buckner told local station KTHV the shooting happened early this morning at the Power Lounge after”some sort of dispute broke out between people inside”.

Police said all 17 victims, some of whom suffered injuries while fleeing, are alive and one victim who was previously listed in a critical condition is now stable.

Police said they “do not believe this incident was an active shooter or terror-related incident”, adding: “It appears to have been a dispute at a concert.”

    Labour are hell bent on getting Murphy re-elected. He’ll make a martyr out of himself and romp home in the GE. The leak to the press is the worrying part. I’m not a fan of Murphy but this is a stupid mistake by labour and I see it backfiring on them.

    The government party shills must be chasing promotion when 5 of them are peddling their guff at 6 in the morning.

    The false imprisonment charges are ludicrous. The farmers (correctly) blockade the meat factories for 2 days and there isn’t a peep from the establishment. On the same weekend, the people of Jobstown blockade Burton’s car for 2 hours and it’s the end of civilization as we know it.

    The leaks and political prosecutions are a serious attack on the democratic right to protest. Massive Garda and DPP resources are being used to criminalize protest and communities in Tallaght. The aim is to strike a blow against the anti-water charges movement which threatens not just the government’s water charges, but their whole austerity agenda. It won’t work and there will be a huge show of protest on August 29th at the next Right2Water national demonstration.

    I hope he gets locked up. He’s a political lier like all the others. Making promises he can’t keep and leading a rabble onto the streets. Not all but a strong minority who want the destruction of society. Selling the kings clothes to get elected. Just like Kenny, Burton, Adams, McDonald, Ahern, Haughey etc etc.
    The public will never vote for those who tell the truth. You can’t have any more because……. I can’t tax the rich, there aren’t enough of them and they already pay 56%, I can’t tax companies more it’ll affect employment! I can’t tax the tax exiles! they don’t live here……. If you want more services I can only tax you or cut public sector wage and pension costs……. If I remove water and property taxes I’ll have to increase other taxes……..
    I’ll run on that platform if I get enough green thumbs.

    I’ve been on this a few months now coddler and this is at least the 5th time someone has mentioned troll, my new Twitter acc or shill. Usually it’s from the SF supporters to be fair. I don’t use Twitter so I set up the acc just for the purpose of commenting here, I think that’s allowed. I’ve never voted FG in my life as I don’t like the lads running in my constituency. I’m not peddling anything except my opinion which you are welcome to disagree with but try a little harder than name calling.

    I want to get peoples opinions though

    Is it mob rule when farmers blockade meat factories or hold a picket against unfair wages song people from entering (the dunnes picket line for example)

    If a car crashes on a motorway (or any road for that matter) and brings traffic behind it to a standstill for hours on end can the person who caused the incident be charged with false imprisonment / mob rule etc?

    My identity is irrelevant. My political allegiance is relevant on a political discussion forum like and that’s clearly stated.

    The actual identities of Jimmy Jones, MK76, One True Voice, talkingsense etc etc etc don’t matter either and I never ask them who they are .What does matter is which political party they represent and that’s why I call them out.

    You own username Alan O’ Connor may be entirely fictitious as far as we know. That doesn’t really matter either but if you were a member of FF for example then that should be known in the interests of transparency.

    As per the article, it doesn’t matter if he organised it or not, or if he initiated the false inmprisonment, if he if sound to have prolonged that detention, he could be found guilty:
    “The text advises that, in cases of false imprisonment, a person need not have originally imprisoned the individual to be guilty of that crime. It has been shown that they may be considered guilty of that offence if they continued a wrongful detention.”

    While many do not support FG/Labour – that does not mean that your Party (the one that disowned you) is the only alternative – that is what you are saying – either share my allegiance or you are a blueshirt.

    I love when you get people like coddler who claim to be the face of the anti profit socialist austerity people’s alliances or whatever name they give themselves. He does a marvellous job of showing why people with a modicum of intelligence should never vote for them.     Reverse all cuts and restore staff levels

    So – to fund this:

    End the bailout
    Tax the rich

    There you have it – lazy policies, half baked (actually not even half baked – raw really).

    Gripping stuff, pie in the sky and written with the full and absolute knowledge that they will never get into power – thanks be to god.

    Good man Patsy. Thanks for posting up what the AAA stands for. I was busy and hadn’t the time.
    Now let me explain to you why things are the way they are, who benefits from the status quo and how the AAA alternative can be funded.

    (You’ll find this difficult to comprehend but try hard now like a good lad)

    Modern fiat currency money is not a scarce resource. It is created at will by the institutions public (central banks) and private (commercial banks) that are authorized to do so.

    The money has no intrinsic value, is created primarily on computer keyboards and so largely exists as electronic account entries. All financial assets are matched by an equal liability and so cancel each other out and ultimately net to zero. What remains is the real wealth of goods and services primarily produced by the working class through their labour. Financial assets (money) is a claim on that real wealth and therein lies its power.

    Government spending creates new money from nothing and puts it into circulation while taxation removes money from circulation and extinguishes it. Taxation is what ‘backs’ the currency. The government imposed tax liability creates a demand for the currency, ensures it is widely accepted and so gives the currency legitimacy. Taxation is also the mechanism by which money can be removed from circulation.

    A sovereign currency issuing state like the U.S, U.K., New Zealand etc. does not need to raise tax revenue from private sources in order to spend on its social program such as pensions etc. The government/central bank is the monopoly issuer of their own currency and simply keystrokes the necessary money into existence.

    Therefore these nations do not need to tax in order to spend in their own currency. The act of government spending is what actually creates the money which is then later removed from the economy via taxation. Such a state could for example implement a large scale social housing construction program to address the homeless crisis which Ireland currently faces. This would involve the government simply crediting the bank accounts of the builders, material providers, etc as necessary to have the homes built with the added benefit of creating desperately needed jobs in the construction sector. This contrary to neo liberal myth is how sovereign governments (e.g. New Zealand) actually spend in their own currency. They face no financial constraints whatsoever in that currency. The state can afford to buy whatever resources are for sale in the domestic currency.

    For example, this is how sovereign governments pay the wages of their public sector employees. So the £2000 monthly salary for a nurse in Britain will see her Barclay’s account credited by £2k (broad money) and Barclay’s reserve account (base money) at the Bank of England increased by £2k, all done by simply pressing the necessary computer keys.

    The state may face real resource limitations e.g. energy or skills shortages but not a financial constraint as it can never be insolvent in its own currency as it issues that currency. However if a state, promises to convert its currency to something else e.g. another currency or gold as a fixed rate, then it faces constraints in that other currency or commodity.

    So nations which maintain a peg with the dollar for example must earn (through exports usually) or borrow reserves of dollars in order to maintain the peg. Greece and Ireland are effectively users of a foreign currency, the Euro and so are even further constrained. This is a deliberate design feature of the Euro which confers enormous power to the unelected and ultra capitalist institutions of the currency union such as the ECB who now hold the purse strings rather than the elected governments of the member nations.

    The macro economy of nations and the globe is fundamentally different to the micro economics of business and households (private sector) who are users of the currency but not the issuer. A sovereign currency issuing government can afford to buy whatever resources are available for purchase in its own currency (including the labour of the unemployed) as they can never run out of keystrokes and so a budget deficit should not be considered a problem once this understood. The U.K. can sustain any size of budget deficit or national debt once it is denominated in sterling as the debt and interest is serviced via simple keystrokes at the central bank. That is why the enormous £850 billion bank bailout in the U.K. did not bankrupt the nation as it did in Ireland’s case.

    Therefore the budget deficit (or surplus) should always be allowed to float to whatever level is required to support full employment to maximize productive output while maintaining price stability. As the economy approaches maximum productive capacity with full employment, the state can then remove money from the system via taxation and reduce government spending to counteract inflationary pressures.

    Neither do sovereign states need to borrow from anywhere in order to finance a budget deficit. When those states do choose to issue government bonds the primary objective is to implement monetary policy (usually to drive their chosen base interest rate to target) not as a necessity to raise revenue. The primary mechanism is that the government will issue new bonds/bills/treasuries which pay a higher interest than the central bank reserves which the commercial banks hold and sells them in return for any excess reserves the private banks may have. In the reverse transaction, the central banks ‘buys’ back the government bonds in return for reserves in an effective asset swap with the commercial banks when they need to increase their reserve supply. The primary function of these transactions is to drive the base interest rate to the desired target. The central bank selling bonds drains reserves and so increases the interest rate on reserves while buying bonds injects reserves and so lowers the rate.
    The central bank reserves and bonds/bills/treasuries are created electronically at will by the central bank/treasury as necessary to maintain liquidity and the desired overnight interest rate in the interbank reserves market. In this way a sovereign country can never really default on its own currency denominated debts unless it chooses to as the central bank can always ‘buy’ back the debt with newly created central bank reserves which every commercial bank requires to function. In addition, when those countries do ‘borrow’ in the market, it is clear that they effectively decide what the yield/interest will be unlike the Eurozone nations subject to profiteering by bond speculators.

    So since the gold standard was discarded in 1971 and the introduction of the fiat floating currencies there is no need whatsoever for a currency issuing government/central bank like Australia or Japan to ‘borrow’ at all in its own currency to raise revenue. They can and do simply keystroke the currency into existence at will. This is why sovereign currency issuing governments actually control bond interest rates regardless of the state of their economies. The government ‘debt’ market is in reality a risk-free, interest bearing deposit facility for the large financial institutions and ultra-wealthy.

    Continuing this neo liberal agenda, the Eurozone was deliberately designed to allow private banks (markets) to profit to an even greater extent from member state debt. It’s only the Eurozone countries that are required to borrow their own currency in the market at an interest rate determined by the market as the EU allows the financial markets to set the borrowing rate for Euro countries on an individual basis with the ECB is the sole issuer of the currency and the nations prohibited from creating the currency themselves.

    There can never be a shortage of money at a macro level so it’s clear that austerity and deprivation is a policy choice at national government and EU level. There are no shortages of any of the real resources (e.g. energy, food, material to build housing etc.) to eliminate poverty across the EU. The authorities pretend that there is lack of money to address the poverty of the citizens when in fact there can never be a shortage of a fiat currency like the Euro.

    Neither is inflation a concern in the current recession where vast resources are available and many more resouces (including labour) are lying idle. There is no simple linear relationship between money supply and inflation despite what the establishment vested interests would have us believe. The point at which inflation rises depends on the availability of real resources (goods & services) versus the actual demand for purchase.

    So the creation of new money is not in itself inflationary if there is sufficient real wealth (goods & services) to buy with that new money. This is especially true if the new money is directed to the productive sectors of the economy for example through infrastructural improvement which leads to GDP growth and so more availability of real resources to purchase. Another key factor which prevents inflation is large scale unemployment where the productive capacity of the economy is not close to its peak. In this scenario which we currently face in Ireland and across Europe, the labour of the unemployed can be purchased with newly created money with no risk of general inflation. In fact the Eurozone is now facing deflation due to the fall in aggregate demand through 6 years of austerity. The enforced shortage of fiat money which are in reality just keystrokes at ECB level is a political choice, not an economic necessity.

    This is so because the capitalist class benefit disproportionately in both the boom and bust phases of the inherently unstable capitalist economic cycle always at the expense of labour (vast majority). Therefore that elite and their political enablers continually promote policy and measures to inflate the booms and deepen the busts at the expense of the many.

    So the booms are fueled by massive credit expansion through the commercial banks as we saw during the Irish property bubble. This drives up asset prices and profit margins for the plutonomy at a much faster rate than any wage increases. The capital owning classes have always known when to get out of the losing plays in time while a complicit media will continue to cheerlead the booms to manipulate the masses until the inevitable crash occurs. (This will sound very familiar to Irish ears).

    In the reverse, the supply of money is restricted to deepen and prolong the bust. As we can see under the Austerity program, the ongoing recession and consequent unemployment is being used as a lever to viciously drive down wages and working conditions which also maximizes the gains to capital. In parallel, the national assets (like water) and social support systems (like health) are shredded and opened up for predatory fire sale purchases and privatization which enriches Denis O Brien and his ilk.
    Economic stability is relatively unprofitable for capital but the vast majority of us are far better served by a stable system with modest economic growth ultimately limited by environmental, resource, population factors etc.

    The ECB is the monopoly currency issuer of the Euro and faces no financial constraints within that currency. There can never by definition be a shortage of a fiat currency like the Euro. So if the EU/ECB chose to, they could simple keystroke the necessary money into existence to hire all the idle labour resources in Greece and the rest of the Eurozone to maximize the productive output of real goods and services and drive up living standards for everyone.

    This would meet the twin objectives of creating real output for consumption and distributing it to the people who need it via their wages which are then used to buy those real goods and services.
    This would restore the entire Eurozone to growth within a matter of months. It’s an ideological and political choice not to do so.

    Still rattling on Coddler with your bullshit economics? Learned nothing from the Greek experience, Argentina, Iceland and now China. All money supply crises though for different reasons. You alway present that governments have no consequences for printing money. No devaluation, no increase in interest rates and no willing buyers of bonds or shares in the particular country.

    A final question. Do you have work to go to as you seem to spend the working day posting on article after article in the Journal? Maybe you are financed by the taxpayer?

She/he then lists a link (the same one) to some lefty economists paper which when you read it you realise quickly he has wrongly interpreted and selectively quoted. As we know all the lefties like to demand the world they would like rather than the world with humans and all their foibles. Self interest, family first and handy earnings paid by someone else. They disavow personal responsibility.

    If any member of the public was surrounded by a political mob, shouting and chanting aggressively around them and making threats upon their person for two hours, that counts as imprisonment.

    If Gerry Adams was driving down O’Connell Street and Willie Fraser and his Orange march surrounded his car for two hours and prevented the car from proceeding and taunted him through the windows, I expect there would be a very different attitude on this forum.

    Jimmy He was referring to the car, Joan wasn’t physically held against her will the car she was in was blocked from driving away there was nothing stopping Joan from leaving the car, so the charge of false imprisonment doesn’t stack up.

    Jason, the sexist card? It isn’t remotely sexist to acknowledge that women in such mob situations are likely, for good reason, to feel more afraid for their safety than most males. If my wife or any female relatives were caught up in a similar situation I think they would find it a more hostile and threatening position to be in than would most of my male relatives. But anyone, male or female, who is hemmed in by a baying mob most find the situation frightening. Baying mobs are not known for their rationality. The fact that you can’t bring yourself to acknowledge that women may have stronger reactions to situations of potential violence than most (but not all) males speaks volumes. You must have little experience of the real world, of women, or indeed actual violence.

    By that very statement Murphy took control over the situation.
    The Guards didn’t because they identified with Joan Burton whereas the Guards should have been impartial and taken control over the situation long before it arose.
    To me it seemed that there was a lack of instruction coming from their commanders which of course has been resolved.

    False imprisonment doesn’t stack up, unless the car doors were somehow locked from the outside, she wasn’t prevented from leaving the car, the sit down protest prevented the car from leaving the area, she chose to remain in the car. If she feels she had to remain in the car for her own safety, then that decision was hers.

    In fairness, it was caught on camera that the Gardaí in charge of the situation made a number of poor choices culminating in the decision to keep Burton where she was ‘held hostage’ by the protesters. The Gardaí made the call to keep her there.

    It’s going to be an uphill battle for the prosecution to put forward any evidence which could be taken seriously. That is assuming it isn’t thrown out due to the potential perjury the leak has caused.

    The mob might have done far worse had she stepped out of the car. They’d already thrown objects at her and hurled verbal abuse and threats through the windows.

    The Gardai were right to let the situation simmer down.

    The court case should focus on whether Murphy’s megaphone announcement of ‘So, will we let her out?’ indicated he was in control of the mob, was jeering and determined the time to cease the imprisonment, or if he was trying to diffuse the mob and establish some leadership to allow her get safely free. He has already made the latter argument in his defense.

    If a bunch of out of control irate water installers and John Tierney surrounded Murphy in his car for a few hours, shouting threats through the wondows and impeded his passage until Tierney made the call to release him, I’d expect the Gardai to bring charges against Tierney and his gang.

    Law does not require any sort of physical restraint or barrier to constitute false imprisonment.

    You can assault someone without ever touching our attempting to touch them… All it requires is reasonable belief on the part of the victim that they could come to physical harm at the hands of the perp, coupled with an immediate and present ability of the perp to do so.

    So apparently throwing water balloons and insults are now valid indicators of an individual’s likelihood of committing an assault? What a ludicrous claim.

    The simple fact is Burton could have left at any time but Gardaí on the scene at the time made the decision to keep her there. She obviously didn’t look threatened, intimidated or distressed at any stage from the comfort of her state-provided Audi from photographic evidence of the incident.

    That was exactly what the Gardai were trying to achieve you eejit. 40 Gardai arriving in riot gear would not have helped; but it would have played right into the hands of Murphy and his gang who were looking to antagonise, just as hours of youtube footage shows with the ‘peaceful protesters’ trying their best to spark off a garda reaction.

    Despite your best wishes, the protests were peaceful with the worst offence being the throwing of a water balloon (by a person who wasn’t even involved in the protest) and the usage of colourful language.

    The Gardaí could have removed her at any time. Do you honestly think anyone in the Gardaí would care about ‘escalation’ if the Tanaiste was in clear and present danger?

    She was exposed directly to the public at multiple stages throughout the protest yet no violence occurred. Your point is tenuous at best.

    All of this emotive ‘what if’ nonsense doesn’t stand up to scrutiny or the facts relating to the protests. No violence occurred during the protest, Burton was exposed for a significant time without the protection of her car yet no violence occurred, the Gardaí made no move to call in reinforcements and no arrests were made on the day.

    False imprisonment ? It hardly was. Did anyone get assaulted? Anyone hurt ? Apart from their pride ? The people just have enough, were they boisterous and acting aggressive ? Yes, but no one threw a punch or a kick at anyone. I really believe they should put it down to experience and learn from it, in all fairness it could have been policed and managed much better. The money already wasted chasing this could have been much better used elsewhere in the justice system, there’s a whole lot worse going on out there and nothing done about it.     It’s not that people are saying that the Gardaí didn’t do enough, it’s that they could have used much more of their powers and resources to extract Burton if there was an actual threat to her from the public.

    They didn’t, meaning using any force was deemed unnecessary by the law enforcement controlling the situation at the time. If the police saw no reasonable threat at the time then it can be easily argued in court that no reasonable threat existed.

    Hell, even Burton’s attitude of smiling at the camera and laughing on her phone contributes to the overall picture of a petty and vindictive outlash rather than a genuine enforcement of the law.

    Jason I’ve watched those clips on you tube and to say there was no threat or the guards weren’t overly concerned is just utterly ridiculous.     Actually Stephen the definition of assault was meet when the taniste was struck with a water balloon. Also a number of Gardí were assaulted and had equipment such as pepper spray were stolen

    So Jane, did this incident happen in the middle of the countryside where little in the way of police resources are available or did it happen in the capital where emergency resources are available on short notice to protect the second-highest member of government if that person is in genuine danger?

    The Gardaí made no attempt to extract Burton for over 2 hours, made no attempts to break up the situation and no attempts to call in reinforcements. If that isn’t a sign of either incompetence or, more likely, a lack of a credible threat to Burton’s safety then I don’t know what is.

    The objective of the protest was to get Garda re-inforcements to arrive and create a ‘fascist police state’ image.

    Jason, a heavy handed Garda approach would have probably escalated the situation, the Gardaí attempted to contain and limit an all ready difficult situation.

    Don’t forget The taniste and her entourage that were effected, there was damage done to private property in the area on the same day during and after this protest as a result of the atmosphere created around it.

    There is so much ill informed comment on this site. Assault is where someone directly or indirectly applies force to or causes an impact on the body of another. However the legal definition also includes situations where a person believes that he or she is likely to be subjected to any such force or impact.

    Anyone who says Joan Burton or her staff weren’t assaulted is wrong. Anyone watching the video footage (which these protestors out on the Internet themselves – no Garda dirty tricks here) would realise that there were objects being thrown and the victims would clearly have felt they were. Out to be subjected to some force by the mob around them. Throwing water balloons, eggs and encircling people in a menacing fashion clearly amount to an offence of assault. The false imprisonment charges will be based on much the same facts for the time when the victims were in their car.

    It’s ok to oppose water charges and to protest, but behaviour like we saw last autumn is completely unacceptable.

    I wouldn’t take part in something like this but i also have no sympathy for Joan. Politicians need to be held to account. Joan does herself no favors either whenever she opens her mouth.

    Anyway this isn’t protesting really, it is an angry mob venting their frustration against a politician who has contempt for the people she is supposed to be representing.I wonder if any of those people were labour voters?
    People are fed up with politicians who make false promises and tell lies to get into power and if their lives are made harder on account of politicians decisions who don’t seem to be affected by austerity at all you can expect this to happen in any country. In fact a lot worse has happened in other countries implementing austerity.

    The DPP hasn’t prosecuted a Gard found guilty of rape by GSOC and an internal Garda inquiry, yet is seeking to criminalise 20 people for what was a minor inconvenience to one politician for just 2 hours over the course of a protest in which nobody was hurt physically, mentally or emotionally. Perspective anyone?

    Murphy’s supporters argument is that Burton should have opened the car door and stepped out into the melee; thus demonstrating she wasn’t in fact imprisoned.

    Judging by the frenzy of the crowd in the video, if Burton had done that then we’d have had a more clear cut case of multiple aggravated assaults on her.

    The outcome would not have been the peaceful de-escalation the Gardai managed to achieve without getting heavy handed.

    Guy comes to open shop, finds it’s been burgled. Talks to family on phone & is noted to be laughing at something on the phone. That means he’s not really been burgled?
    Girl comes into the gardai reporting she’s been raped. She’s seen on the phone to be laughing with mates who are supporting her as she waits for her claim to be processed. Does that nullify her rape claim?

    That’s not what people are basing it on i don’t think Colm. I think there would be an element of proving she was not in fear of her life, her demeanour would have an awful lot to do with proving that. Part of the blame also rests on the shoulders of the members of the gardai who utterly failed to keep her safe. She is the tanaiste after all. She is always going to be under a certain amount of threat weather it is acknowledged or not. It comes with the job. I am not justifying the behaviour of the protestors here but lets be fair, if the government took the protests and what they stood for seriously at the time this would never have been able to happen. They would have sent enough security with the tanaiste to guarantee her safety or that she doesn’t get “falsely imprisoned”.

    On a side not, it’s mind blowing that Burton would wish to proceed with this. I know she doesn’t expect to be in government come the GE but with this kind of thing she will be lucky to even be in the labour party. She is leaving a toxic mess for her cohorts to try and clean up before the vast majority of society will ever entrust anything in the hands of the labour party again.

    Brian, even if Joan herself didn’t want this to go ahead (to be honest, I think she would let this go if she could), I would as a citizen. Law is law is law is law, and I want law to be pursued in this country. Mob rule is not how we decide what is right and what is wrong, and we must, as a society, see justice done, send the message that “No, this is not how we change things.” We’ve seen the dark road that Direct Action protesting drags us down North of here, and it took many lives before we were able to sign the GFA and make protesting a notable event instead of the firebombing norm. I want this protest dealt with in law, that certain actions are allowed in protest and certain actions are not. Yelling “peaceful protest” does not a peaceful protest make. I don’t trust what any politician, left or right, any protester, left or right, says. I trust what they do. That’s what tells me who’s right or wrong.
    A representative of my country was detained by people without the lawful authority, or a justifiable reason to do so. Wouldn’t matter if it was my President Micheal D, or Mary Harney when she was looking to Boston in the US as a model as Health Minister. Great love for Micheal D personally, great animosity to Mary H personally. I would react exactly the same way. This was Wrong, and law should clarify as such, & punish the wrongdoers.

    Colm. The thing is the guards were there when this crime took place. They watched it happen, they allowed it to happen. It’s not as if Joan reported it later. A better analogy would be a gang rape taking place in full view of the guards who did not attempt to stop or prevent it. If this is to be considered false imprisonment, then why did the guards make absolutely no attempt to stop it? Why was there no hostage negotiation? That’s a real mystery. Since you introduced the rape analogy, it would similar to 20 guards standing around watching a gang rape in progress and not intervening.

    Are videos acceptable as evidence of fact in court of law? Just wondering in general without specific reference to this case. Is there a process of authentication? Also is it difficult to establish when a car is detained by a crowd which individuals if any are actually responsible? What is the difference between delay and imprisonment in the eyes of the law? No arrests were made by Gardai at the time on the basis of false imprisonment were they? Does this suggest that the Gardaí did not interpret the scene as a case of false imprisonment at the time? The Gardaí walked with the Tanaiste from one car to another, I believe? Were the Gardaí falsely imprisoned and if so why did they not call for help? It seems to me there are many questions about the event that did not seem to be issues until after the event itself and relate to the video? The Tanaiste was reported to be smiling? This suggests to me that she at the time interpreted events as non threatening. I was not there and have not looked at the video myself. I do not support false imprisonment in any shape or form and I strongly object to any form of attack on Gardaí or elected representatives or individuals by protesters or any others. I do support the right to protest.

    Alan, read the definition of unlawful imprisonment in the Irish state. How the victim felt is actually a crucial part of the law. If the victim was having a great time chatting to people on the phone in the middle of the incident, she was hardly fearful of the crowd and the claim of false detention becomes tenuous.

    Normal intelligent people in Ireland see Murphy and his mob having nothing to do with their own attitude to water charges.

    When doorstep time comes and the politicians start calling, I’ll be voicing my view on the apparent millions squandered setting up IW, but I support fixing the system, detaching it from the bloated State machine and isolating all things water into one institution, with its own set of accounts that will need to support itself without the millions in taxpayer money that currently gets lost in the system.

    So now the question is, who ‘leaked’ the story of the upcoming charges? It seems to me that Mr Murphy has found a very handy way to get his upcoming Protest into the Media, all while not actually facing any chargers yet.

    The charges will be after the election, according to the front of todays papers. So this story from yesterday that Murphy et all face imminent arrest is complete bollox. But that doesn’t matter to Murphy, he got his headlines.

    Whether she was falsely imprisoned or not is not what I’m looking at. What’s important here is the feeling and aggressive nature amongst the public is a clear indication of how tired of these cuts and taxes imposed on them from a government promising the opposite at election. Now continuing to lie and imposing more austerity on people will eventually give rise to this type of behaviour. Although I believe worse is to come, this going to court will only serve to enrage further Joe public. Water was the trigger. Eventually a trigger would be pulled. Now with more and more families on the streets, people are saying, enough is enough. Fg/lab have slashed to deep into the finances of ordinary people to ensure the status quo remains. The gap between wealth and poor in society is alarmingly larger in this last few years. Revolutions have always happened with these ingredients. Ireland as we stand is on thin ice.     I’ve just watch a link of Joan being held up in her car. First, the gardai put up with an awful lot of abuse from a baying mob is the only way I can describe them. Gardai were violently pushed and shoved , had their hats knocked off and were being called terrible names etc. I think Joan was intimidated and threatened but to cover up she used her phone as a distraction to laugh and smile. If you look at her assistant in the car , her face appears worried and scared. The constant hammering of the car and the vile verbal abuse would unverve and scare anyone and a lot of people in that crowd were so aggressive . That is not the way to behave at a suppossed peaceful protest.

    There was a FG councillor attacked and had his face scrawled in Clonakilty town about a year or two ago ,. There was a bit of a hullabaloo about it for two weeks or so but ,we don’t hear anymore about it now ..This scenario seems to be a tad more serious and it will now go to the courts .. It won’t help Michael Mc Carthy’s chances if that is what they’re hoping for .. It will be interesting to see the outcome from all of this ..

    Jason. I don’t think you understand just how serious False Imprisonment is considered in law – it carries up to life in prison – i.e. it can be considered as serious as murder. This is where the attitude of “they can’t arrest us all” is so dangerous – sometimes you end up being charged.

    “Non-Fatal Offences Against the Person Act, 1997

    False imprisonment.

    15.—(1) A person shall be guilty of the offence of false imprisonment who intentionally or recklessly—

    (a) takes or detains, or

    (b) causes to be taken or detained, or

    (c) otherwise restricts the personal liberty of,

    another without that other’s consent.

    (2) For the purposes of this section, a person acts without the consent of another if the person obtains the other’s consent by force or threat of force, or by deception causing the other to believe that he or she is under legal compulsion to consent.

    People need to take a step back here, forgot about water charges, forget that paul murphy, and joan burton were involved. If this happened to ordinary people tomorrow in any other part of the country, people would be up in arms over it. When this goes to court, you get the law, and the law was broken here.     Were the 40 Gardai surrounding the car as well also falsely imprisoned or just completely ignorant to the fact the person they were protecting was being falsely imprisoned?

    I was stuck for an hour in Dublin traffic when the truckers had their protest and again when the taxi drivers did the same. Are we going to lock up all the taxi drivers and truckers next for stopping traffic or is it just when iphone Joan has it happen to her it becomes worth prosecuting?

    She was delayed by a protest nothing more. One ejit throws a water balloon and everyone acts all sanctimonious. This woman and her policys have directly lead to homelessness, tax increses, implementing harsh austerity measures such as cuts to child benefit, loss of medical cards for disabled children, cuts to carers, age discrimination two tiered job seakers benifit, failure to reform or remove inefficient quangos and cuts to special needs teachers. The worst of all in my opinion is high treason by making private debt sovereign debt and putting a figurative cross on my shoulders, on my children’s shoulders and their children’s shoulders to pay an unpayable debt on prom night. Given that I suggest some of you save your outrage and aplaud the restraint of the protesters quite frankly for not hanging her and every TD in FF, FG and Lab for what they have done to some families who are now homeless, and torn apart many more emigration. I have lost lots of mates to Australia due to the last government and current government and I will never forgive Irelands Helen Lovejoy “oh think of the children Burton” FF, FG or LAB .

    As with most things, the reality lies somewhere in between. Murphy and his supporters clam this action is being taken because Joan Burton was “delayed”. No. It was an aggressive action spearheaded by a small group of individuals and the gardai felt the level of threat warranted swift action. HOWEVER. Their anger at any figure of government authority was hardly unjustified and in no way, shape or form was it false imprisonment. This should be laughed out of court, but had the Tanaiste not been moved to another car and taken swiftly from the scene the protesters need to ask themselves, how far would they have gone?

    It’s actually very easy to see how it was not an offence. At any point the Gardaí could have escorted her out of the area but instead chose to keep her in place for 2 hours. The crowd had already shown that they would not physically assault her when the Gardaí escorted her from the school to her car.     Patlyndo, the AAA are a spent force. The recovery has defeated their arguments. The Greek crisis also focussed the minds of the “burn the bondholders” brigade. It must be galling for Coddler after 6 years of bullshit economic argument. I tired if his and people like him waffling on anonymously. Murphy and Co are from the same school of economic fatalism. Its the 30th anniversary of the UK miners strike. We know what happened them after Scargill gave them a “Murphy” style script. Capitalism has its faults but Communism definitely doesn’t work. Even the Chinese are gradually ditching it. I lived through all that as a grown adult. Unfortunately the young Marxists want to put everyone back on a failed dogma. They should speak to their Grandfathers.

    This would be a terrible precedent to set. If this type of action, ie blockades, stopping traffic etc becomes defined as false imprisonment then we’re in trouble, it could be used to shut down any protest, even one you like.

    Jobstown has taken the worst hits, in this crisis. It is a community under siege. The government, and many people commenting on here, are dehumanising the poor, in order to justify the massive cuts inflicted on Jobstown and communities like it, across the country. It is the absolute worst aspect of our culture, that we can collectively engage in poor-mouth one-upmanship, feel spectacularly sorry for ourselves and complain about how the recession has impacted on us, and yet have zero sympathy or compassion for these communities. Every aspect of life has been made impossible. Cuts to social welfare payments for young people, lone parents; cuts to funding for community resources, cuts to education (especially special needs interventions), cuts to addiction interventions and awareness campaigns, cuts to grants and increases in college fees; property and water taxes, discretionary medical card withdrawal, which left children with chronic and terminal illnesses without access to treatments for months; increased prescription charges, meaning elderly people have to choose between getting the medications they need and eating; rising costs of food, fuel, utilities; cessation of all county council urban improvement, meaning streets are not swept, bins are not emptied (this does not happen in wealthier areas)- the list goes on and on. Yet, because people from these areas have been dehumanised, when they express frustration or anger at the decimation of their area, at the diminishing prospects their children have, they are branded as ‘animals’, as ‘unreasonable’, as ‘thugs’. Many people from these areas voted for Labour. They were made promises, and they have been spectacularly betrayed. They have to watch the government they elected blame them for the recession, tell them they are ‘allergic to work’, that they choose poverty, that they are in need of forced ‘activation’. They have to witness JB, instigator of so many terrible failed policies and interventions, stand over these cuts and claim that she speaks for them, she is somehow doing them the favour of getting their lazy useless incompetent sub-human behinds back into the workforce (or unpaid indentured servitude in Jobsbridge), when every thing she does makes their already awful situations just that bit worse. It is this attitude that makes people feel personally angry with her. In light of this, how did she imagine hijacking the graduation would go? Ruairi Quinn gave promises to students pre-election, then savaged grants and increased fees, making higher education inaccessible to kids from these areas. To then stand over the miraculous and hard-earned success of their children, and claim it as a victory and photo opportunity for Labour, was absolutely grotesque. The crowd can clearly be heard screaming ‘answer your people.’ Paul Murphy can be seen arriving in, calming the crowd down by giving them directions. He encourages people to ‘keep it peaceful’, and this can be heard echoing across the group. Anyone who begins to get out of hand is immediately directed by one of their own to calm down and stop. The Gardai did not prevent things getting out of hand. They were confrontational and antagonistic. The people of Jobstown showed admirable restraint and dignity, in managing their own protest. JB refuses to answer questions in the Dail. She sneers at and demeans the opposition, arrogantly dismissing their right to question her, instead of addressing the questions they have been elected to ask. The only option people have is to protest, because they are not being listened to or respected, the people they elect are not being listened to or respected. Yet, when they do, with justifiable anger, exercise their legal right to protest, they are branded as thugs and criminalised. This prosecution is just the petty vindictive ego of JB, putting people she has nothing but contempt for (A Labour Minister for Social Protection, who despises working class people, crazy) ‘in their place’. If it succeeds, any future protests, against any more brutal and regressive government policies, will be in the position of facing arrest and prosecution, on similar trumped up charges. This is extremely dangerous.
