'It's like I'm in a prison': Fears citizenship applications are facing years-long backlogs

A High Court ruling in July has halted the processing of citizenship applications.

APPLICANTS WAITING TO receive Irish citizenship from the Department of Justice fear they could now be waiting years before their applications are approved following a High Court ruling in July. 

In July, Mr Justice Max Barrett ruled in the Jones case that foreign nationals applying to become Irish citizens on the basis of their residence “must show a one-year period of residence in Ireland that is ‘unbroken, uninterrupted, connected throughout space or time”. 

It threw the application process into chaos with applicants who travelled abroad in the last year – including crossing the border into Northern Ireland – worrying their applications are not eligible. 

The ruling has been appealed in the courts and a judgement expected in the coming weeks.

Solicitor Carol Sinnott, whose client Roderick Jones is appealing the July ruling, said there have always been delays in processing applications despite the Department of Justice citing a wait time of around six months. 

“At the moment, even before the Jones case, there has been massive delays in citizenship application. We have clients waiting for two-and-a-half years for a decision on their cases, which is horrendous and nothing to do with the Jones case.”

But with a backlog of applications expected as a result of the legal battle, and as applications have already seen longer than expected processing times, applicants say they fear it will be years before they are granted citizenship. 

Sudan

One Sudan-born man living in Ireland for more than 10 years, and who asked not to be named, said he feels like he is “in a prison”.

“I got all the papers and submitted them to the minister in 2016. I have been waiting since then and have gotten no news,” he said. 

“The last time I received a reply about my application was a few months ago but there was no particular answer to say when I could get citizenship. I got an email saying they received my email but that’s it.”

Foreign nationals are formally given citizenship at ceremonies attended by the justice minister but two ceremonies planned for September and December were cancelled following July’s ruling. 

I didn’t get any date for a ceremony. Since that time I submitted it, I’m just waiting and I’m hoping every time that I’ll come home to a letter or email. Just hoping every day and still hoping now. 

“It’s like I’m in a prison and I cannot go anywhere. My parents are in Sudan and they are getting old. My dad doesn’t understand why I don’t want to see him. We used to be so close and every time he talks to me it makes me cry because I can’t go and visit him until I have Irish citizenship.”

While it has been three years since he first submitted his application, and having been told all of the required documentation was received, he now fears it could be several years before he formally becomes an Irish citizen and can leave and return to Ireland as he pleases. 

Reality

Fiona Finn, CEO of NASC, which advocates for migrant and refugee rights, said the Department’s guideline wait time of six months to process applications was not a reality for many. 

“It’s a frustrating experience for applicants who don’t know where their application is in the queue and don’t have a time frame for how long it will take for their application to be dealt with. Unfortunately, it hasn’t been our experience that applications are dealt with within a six month period.

“The decision in the Jones case caused a great deal of worry for thousands of migrants. We welcomed the minister’s commitment to legislating in the aftermath of the decision, but we have been disappointed that no guidance has been given to people who are considering applying,” Finn said.

Justice Minister Charlie Flanagan said he was working on new legislation proposals to address the High Court’s ruling.

Another applicant from Serbia, who has also been living here for more than a decade, and who asked not to be named, said an immigration officer advised her she could be waiting two years before she is granted citizenship. 

“I have asked for three years about applying for citizenship but was told not to do so – even though I qualified for it in 2015,” she said.

“I officially did it this year through a solicitor, who wrote a cover letter and went through my immigration papers. She sent it all in mid-June, with a record of residency which is part of the citizenship form. I’ve been here for 11 years.

“I got an acceptance letter in August, which very vaguely said ‘we will stay in touch, we will communicate with you’ and that was the last time I heard from them.

“My immigration officer mentioned to me that there will be a huge backlog and you might be waiting until next year, or maybe two years, for my citizenship ceremony.”

Solution

TheJournal.ie contacted the Department and asked if there would be further delays to the application process in light of July’s ruling. 

A spokesperson said: “The outcome of the [court] appeal will have a bearing on whether or not legislation is required. Should it be necessary, the minister intends to introduce a bill in the Oireachtas as soon as possible this term.

“The Department is doing everything possible to put a solution in place on an urgent basis. At the end of July, the minister obtained Cabinet approval for a proposed bill to address the matter and intensive work is taking place in the Department.”

The spokesperson also said the Department was awaiting the outcome of the court appeal before scheduling any ceremonies. 

“As soon as the legal issues are resolved, the Department will make all necessary arrangements for the next Citizenship Ceremony. Invitations will issue four weeks in advance of the ceremony to ensure everyone has adequate notice.

“The advice to those who are planning to apply for citizenship is to continue to collect all of the necessary proofs that support their application and to submit a comprehensive application form. Once a solution is in place, if any additional information is required, applicants will be contacted as part of the processing of their application.”

    @Tony Moore: Not everyone who is applying for citizenship is a refugee or a free loader. My husband has lived here for almost 20 years. Depending on the outcome of Brexit he may apply for citizenship, he currently travels home once or twice a year, if he wasnt allowed to travel home for 3 years while he waits for his passport it’s quite possible his Nan, Dad and sister may die during that time as they all have health issues. He has has paid a hell of a lot of tax over the last 20 years. He is lucky that being British he is in the common travel area and doesn’t need to reapply for a Visa every few years, but if he wants to vote or hold an Irish passport so post Brexit he can stay in the same queue as us at the airport he will have to not travel home for 3 years. How is that fair.?

    @LittleBee: The law of the land is for a Nation not individuals . Put it to a referendum , thats how laws are changed. If i eant to build on to my house i have to get permisdion i lived in it for 30 years . If he lived here fir so long he shoukd have applued years ago he chose not too . His choice ?

    @Diogenes O’Mahoney: totally missing the point there. If someone has to have continuous residency for 1 year (plus the required amount of normal residency) then that’s grand, but if the state are not being efficient and delays are being experienced because of a court case which means applicants cannot leave the country for an unknown period of time such as 3 or more years then that is a completely different issue. Many of our industries are held up by a work force of foreign nationals, who are glad to be here and pay tax and are good hard working residents., but to not allow then travel home for an indefinite period of time because of legal and cerical issues is not right.

    @Tony Moore: except you have to have 5 years ordinary residency out of the previous 9 years so given hes here 11 years he did apply in a timely manner. You cant vote in a referendum unless you are a citizen. The criteria is that he has continuous residency for 1 year previous to his application but because of an unrelated case he is waiting 3 years. If you had to wait 3 years for planning permission to be approved because of a legal issue with some unrelated case you would be a bit pissed off no?

    @Declan Edward: What makes you sick ? That my husband after working and living here for 20 years would like to be able to stand with his wife and 3 children when we travel. That he would like to vote in a referendum? Why on earth would that make you sick? It costs €1000 to apply for citizenship he hasn’t needed to apply before now as other then voting in general elections or referendums he leads the same life as anyone else but but post Brexit he may wish to, not travelling home for a year is one thing but an indefinite amount of years because of unrelated legal issues is another.

    @LittleBee: So your saying the legal system is slow it seems like we are getting swamped with applications. The waiting list for a council house is 5 to 10 years The waiting list for operations in our hospitals is 5 plus years. The application for a medicl card can be 2 years . To get to a court case heard it can be 3 years . To get to see a consultant can be 2/3 years. To get your child assesed for a meficl condition can be p to 3 years. Welcome to Ireland .

    @Tony Moore: oh well in that case, yes Ireland definitely needs more model citizens like you and not hard working educated foreigners , because obviously the only thing that makes a country great is an unmixed gene pool. You should really watch Stephen Frys talk on that, although you need to understand powers of 2, so it might be out of your reach.

    @LittleBee: Individuals on work permits or who have leave to remain who are citizens of foreign countries can travel home as they please. You are conflating this with the application for citizenship which is a privilege of the state to endow on an application they deem suitable.

    @LittleBee: Look its simple , every one hss their problems , we have women dying of cancer because no one though it woth their while to telk them they had it. This country cannot sustain the immigration flow , hence the system is breaking down . Yet people say bring more in that will make things better. We are like,a fice seat family car teaveling with 8 people in it , not safe , not designed for it ,we need a bigger car , but we are broke. So untill the find a magic use fir turf , there no new car coming any day soon.

    @Diogenes O’Mahoney: except there was already a delay of 2.5 years prior to the July ruling when the normal application time is 6 months, learn to read. You are a good advocate as to why we need educated immigrants in this country.

    @Diogenes O’Mahoney: but it’s ok for you to insult someone because of the colour of their skin or their place of birth. It’s ok for you to assume that because someone is asking to become a citizen here then they must be intending taking the country for a ride. It’s ok for you to sit on your high horse looking down your nose at foreign nationals saying how they should be privileged to be allowed here ,when you have absolutely no regard for how well educated, how hard working they are, how much tax they pay or how good they may be to our society. There is a thing called emotional intelligence and it is something you are clearly lacking in.

    @Diogenes O’Mahoney: Apologies that was a collective you more directed at Tony. You’re right though we are privileged in this country. But what I see as a true genuine Irish citizen is a character that is held highly around the world . We are known to be humble and welcoming and understanding of others that’s why we are loved and welcomed all around the world. That’s what makes us Irish and when you chant about how it’s a privilege and not a right you lower the tone of your argument. You start to sound like a Brexiter or a Trumpian. I will open my arms to anybody as long as they work hard, do their bit for society and live within the law. I dont care of their place of birth even if they are Irish born. I hold people on their merits not their passport or birth certificate.

    @GrahamMManning: Thanks Graham we’re fine and at most Brexit is an inconvenience to us. I’m very grateful for that. But it does highlight that if he wanted to apply for his citizenship not being able to return home would mean it impossible given his families health. So we are lucky he can continue with the status quo of the free travel arrangement. Others are not so lucky. Just pointing out that being non Irish does not make you a free loader.

    @Diogenes O’Mahoney: yawn he meets the criteria that’s why he received an acceptance letter. I never once said that anyone is entitled or has a right to citizenship. But he does have a right to be upset and he does have a right to work assuming his current Visa allows it. When immigrants are here and want to work and contribute to our society then we should do what we can to support them because they are all going to be tax payers. Leaving them in limbo benefits nobody but the lawyers and who pays for them. Us the tax payers. Im privileged to study with a broad range of different nationalities their stories are varied but they all work hard and contribute and they all have families back home, they are all people. They get my respect not those who think birth place is privilege

    Place of birth is not a privilege it is a fact. By referendum the people of the republic of Ireland decided to abandon the jus soli principle of citizenship.

    @Tony Moore: I immigrated here, brought my job with me, live well outside the cities where there is much less of a housing shortage, and paid more in tax than an entire median Irish income last year. I like to think it helped treat a few people with cancer.

    But I also think if a department tells you decisions should be done in 6 months and instead takes years with no obvious cause, they’re just taking the piss. The bureaucracy here – for a country with the population of a mid-size city, is sheer insanity.

    @PJ Higgins: im im a college full of them. I live next to pay pal and national pen to name just two who are full of international hard workers. The local Tesco’s and petrol stations and garages all have hard working non nationals. My husband is here 20 years. the man in the article is here 11. My reference to my husband was to humanise the situation of the man in the article because the journal readers have a problem with accepting people with brown or black skin and see them all as free loaders. I’m simply making the point that people should be judged on their merits not their nationality.

    There needs to be more rules to citizenship one off the things they must make a pledge to it obey the laws of the land and. Minors are not expected to even go to ceremony yet if they are teenagers they automatically get citizenship with their parents, we are know what has been going on with young black teens from Balbriggan and clondalkin running wild beating up kids on their own and then using knives in rds at a schools event so obviously not obeying any laws We all also know of weddings taking place which are a sham to get citizenship so maybe its time full citizenships were not given until a certain time a temporary passport for 5 years and if you break the law or its found to be a sham marriage then it can be revoked ..

But you seem to fail to understand that someone who is brown or black and living here is not necessarily a freeloader or an asylum seeker or a refugee. You also see to fail to understand that Irelamd is also full of s@umbags and freeloaders who are white Irish born and raised. So please go out and educate yourself about the wonderful multinational residents and citizens we have in this country and then dig a little deeper and learn about all the benefits they add to our society. Speak to a refugee and ask them their story. Hold people on the merits of their effort achievements and accomplishments, not on their place of birth.

    If people apply for citizenship and meet the states requirements, then we should grant it, or not grant it, if they don’t. The whole process should be done in a reasonable period, like 4 months to make a decision one way or another. Stop wasting everyones time.

    What a field day for people who don’t particularly like the idea of foreigners living here. Thanks be to Godess that our gene pool is being mixed. Better-looking and more intelligent babies is usually the result. The regulation is a bit harsh. There should be provision for family visits, unless it’s a case of political asylum.

    I’m an immigrant here from USA and I intend to apply for citizenship when I become eligible. I know lot of people whose citizenship was granted within 8-10 months. Which I think is a reasonable time frame. However, I do think that there is a lot of red tape surrounding citizenship and there is no explanation given sometimes for delays. Also, I know few people whose application were magically approved within days after a TD wrote an email. People who are commenting that it’s not a prison etc, i don’t think it’s reasonable to hold someone’s application for 2-3 years either refuse or grant within 12 months.

    Irish citizenship should be for Irish people only. It is insane that a citizen of another country can become a citizen of Ireland.

    Im aware of a number of people who’ve successfully applied for Irish citizenship to suggest, that the rules for applying for Irish citizenship are no more onerous than most other countries.

    @Blessopaddy: They’re not really – the rules are pretty reasonable. The frustration is with the judge deciding that “residence” is the same thing as “physical presence” – as though you become resident in Britain because you spent a weekend in London. Also, dealing with inefficient, opaque, Brazil-esque bureacracy that has a huge impact on your life is deeply unpleasant, though that’s true universally.
