Louth woman receives additional 18 months for dangerous driving causing death of a pedestrian

The DPP had appealed the ‘undue leniency’ of Eimear White’s sentence.

A LOUTH WOMAN’S one-year jail term for dangerous driving causing the death of a pedestrian has been increased to 18 months by the Court of Appeal, following an application from the Director of Public Prosecutions.

The DPP had appealed the ‘undue leniency’ of Eimear White’s sentence.

The 23-year-old had thrown a carton of sauce into another car, whose driver then chased her car through Dundalk, resulting in both cars hitting a 29-year-old man.

White pleaded guilty earlier this year at Dundalk Circuit Court to dangerous driving causing the death of 29-year-old Robert McLoughlin.

He was knocked down on 21 October 2017, after getting out of a taxi on the Old Newry Road at Dowdallshill.

Judge James McCourt sentenced White to three years in prison with the final two suspended.

The DPP appealed the ‘undue leniency’ of the sentence handed down to White, who has a former address at Castlecarra, Riverstown.

The victim’s parents attended the remote hearing of the Court of Appeal today, where CCTV footage was played of the car chase that led to his death.

Kevin Segrave BL described the footage, which was stopped before it reached the moment of impact.

“This is illustrative of a car chase through the streets of Dundalk, instigated by this accused throwing a carton of sauce at the other vehicle before driving away,” he said.

“Both were travelling at 81 to 95km per hour in what was a 50km per hour zone,” he said, referring to the time of the collision.

He explained that both cars had hit the deceased, who sustained multiple injuries. However, he noted that it could not be said which of the impacts was responsible for his death.

Different judge

Counsel said that the sentencing judge had formed a view as to what happened early in the hearing. The judge had remarked that White had been ‘stalked’ by the other driver, her co-accused.

“The State’s case was that there was nothing of that,” said counsel. “This accused threw sauce into a car containing three men, one of whom had been guilty of vulgar language and gestures.”

He noted that White had said that she had known the other driver and had reason to fear him.

“How that sits in with the throwing of the sauce and driving away, the State had difficulty with,” he remarked.

Counsel explained that White’s co-accused had been sentenced by a different judge, who regarded him as a person of good character, showing general remorse. He had cooperated and made an early plea.

He also said that there were points of strong comparison between the presentation on behalf of both accused, and both were sentenced to three years in prison.

However, the other judge had suspended only 18 months of the other driver’s sentence, while Judge McCourt had suspended two years of White’s.

Humanitarian and sympathetic

Counsel said that the judge had been very humanitarian and sympathetic to all concerned.

However, he ‘didn’t touch on rehabilitation’ and there was ‘no reference to deterrence’.

Counsel said that he didn’t believe that the DPP would have brought an undue leniency application if White’s sentence had matched that of her co-accused.

Fiona Murphy BL, representing White, submitted that it was clear from the footage that there was a level of stalking going on.

“There’s no excuse, and it was immature and inappropriate to throw the sauce, but to suggest that in doing so she instigated the car chase is unfair,” she argued.

Court President Justice George Birmingham, presiding with Justice John Edwards and Justice Patrick McCarthy, said that the Court of Appeal would not ordinarily intervene for the sake of six months.

However, he noted that in this case, White’s co-accused would be required to serve a 50 per cent greater sentence than hers.

He described the sentence imposed on White’s co-accused as ‘a very lenient one’.

He said it was the view of the court that White’s sentencing judge had fallen into error in imposing an even more lenient one.

He said that the judge had ‘chided’ White’s counsel for suggesting that his client had instigated the car chase.

“It is our view that he (defence counsel) was right that she had instigated the pursuit of her car,” he said.

He said that there would have been no car chase had she not thrown the sauce.

“Had she received the same sentence as her co-accused she should have counted herself lucky, as her co-accused was,” he said.

“It seems to us that the decision to suspend an extra six months was an error. It gave rise to a sentence that was unduly lenient,” he said.

White, who attended the hearing remotely from the Dóchas Women’s Prison, wiped away tears as she was re-sentenced to three years in prison with the final 18 months suspended.

    18 months!!! That’s just wrong on so many levels. It’s still far too lenient. What a slap in the face to the victim’s family

    Is a life only worth 18 months now. If it was one of the judges family would the sentence be the same. 18 months seriously, 18 months for a taking an innocent persons life ??

    what the actual F is wrong with human beings. She throws something into the other car, he gives chase, and she facilitates this high speed chase like they’re in some ffing chuck norris film. ADULTS behaving like uncivilized delinquents. And now a man is dead because of them.

    @Pauline Gallagher: Exactly Pauline, they should both have a sentence of 10 years imposed and serve every day, the poor lad they killed was only 29 years, he had his whole life ahead of him until these idiots decided to race around Dundalk at speeds between 81 and 95km and both of them had hit the victim, they couldn’t even decide who had actually killed him, his poor parents.

    The man walked out in front of the cars that night, after leaving the minibus, having to cross a busy road. None of this will bring him back. Tragedy for all involved including the bus driver, making him cross the road intoxicated.

    Have to say I know nothing of the calibre of the woman or the other people involved in this incident. If I did maybe I might have a different comment to make. That said what is the constant drive to ‘find someone responsible’ for every unfortunate outcome in life.
    That poor dead lad and more importantly his family have had their life dealt a very sad and sorry blow but was that really the fault of an incident that happened some time before in a different location? His bus could have been delayed elsewhere for 1 minute (different outcome). I’ve been there, tragic incident and all around me looking to ‘blame’ a specific individual for it but really it could have been anyone. Sometimes life is for living and with it we take the risks involved… Jailing someone for a bit longer to satisfy some corner of society is not really of any benefit to society or a community.

    @Gavin Linden: There is often an almost unreasonable drive to find someone to blame, hence our compensation culture. However, in this case two people are clearly 100% responsible for the death of this man. It may not have been their intent to kill, but there is no way that someone can be unaware that they might kill someone by driving the way they did. They decided to roll the dice with other people’s lives. I might be entitled to risk my own life, but not others. The punishment they recieved seems light.

    @Conall: Howya Conall and thaks for the rattle, (banter). yes fair point but as I said I can only garner from the article the bare bones of the story. Maybe you have more in’s and out of it and possibly a bad case to voice my opinions on. I still find this generic ‘someone to blame’ a problem in our day to day life.

    @Gavin Linden: “Jailing someone for a bit longer to satisfy some corner of society” That’s not actually while the appeal went ahead. It was to match the equally guilty co accused’s sentence. However this isn’t the time or place to get philosophical about society’s need to blame someone. Join boards.

    In any case I didnt intend to become philosophical, just glad that I did…. I’m walking on water tomorrow between 2 and 4.
    As I replied to Conall I possibly picked a poor incident to raise my view on but it certainly does not detract from my belief that we have become a society/ / community of ‘who will I blame’. Its not all about money or compensation claims, but people are abdicating their own personal responsibility.

    18 months for driving so dangerously they killed someone, its disgusting! Did they even get banned from driving, it doesn’t say? I cant imagine how the poor lads family feel. This is wrong.
