Cabinet agrees gardaí entering homes to shut down house parties would be an 'extreme measure'

Government has u-turned on the idea of sending officers into peoples’ homes to break up gatherings.

JUSTICE MINISTER HELEN McEntee has said that Cabinet felt that allowing gardaí enter the private home of someone to shut down a house party would be an “extreme measure”.

In what is being described as a u-turn by government, the Cabinet decided against including new enforcement powers into proposed legislation that will seek to shut down pubs that break public health guidelines. 

Earlier this month, the government flagged that it wanted gardaí to be given powers to interrupt and prevent house parties.

“We do need immediate sanctions where there’s a clear breach of the public health measures because that clearly has a ripple effect across the wider community,” Taoiseach Micheál Martin said at the time.

It is understood that the issue around how to tackle house parties was subject to a lengthy discussion among ministers.

The constitutional rights of people and their homes was raised around the Cabinet table, and some ministers felt that the penal provision went too far.

Speaking to reporters this evening about why the government backtracked on the idea of sending officers into peoples’ homes to break up gatherings, the justice minister said concerns had been raised by the gardaí and the National Public Health Emergency Team (NPHET) about house parties and social gatherings.

“We looked at a number of options over the last week and a half and what we’ve decided today… is that a statutory instrument would be implemented, around the number of people which can gather in a home, it wouldn’t be a penal provision. 

“I think we have to look at how far do we go here, particularly when we’re talking about somebody’s home. It was found that this would be perhaps an extreme measure, particularly around entering somebody’s home,” she said.

“We really want to work with people here and we’ve seen throughout all of this that people have complied in the vast majority of instances… So this is why we agreed and came to the decision that we did today,” said McEntee.

Tánaiste Leo Varadkar said that while there has been a lot of talk about international travel and workplace clusters, over 90% of  clusters have occurred in private homes, not just house parties, but smaller gatherings too, he said.

“That’s why we’re asking people to limit to six, the number of people who you invite into your home at any given time. That is now going to be underpinned by regulation, so it will be underpinned by law, but it won’t be a criminal offence. You won’t be prosecuted but it will be a civil matter,” he said.

He said this is no different than some of the other regulations that were underpinned by law such as the distance you could travel outside your home a number of months ago.

“This really isn’t about us charging into peoples homes… this is really about asking people to stick with us. We know that over 90% of cases and cluster infections are happening in private homes, and the only way we can stop that is by people limiting the number of people that they invite into their home.

“No more than six people at any one time. No more than three households, that is really what we are asking people to do because that’s what will stop the virus spreading from person to person, and allow us to resume reopening our economy,” said Varadkar.

The Irish Council for Civil Liberties, the Labour Party and Sinn Féin had all voiced their opposition to proposals to grant gardaí the new powers.

    Agree with a lot of the comments above.
    I met him in the early 90s when there weren’t dozens of boats chasing him morn’ noon and night in the summer months.
    He was delightful. I genuinely mourn his departure
    But I hope he just joined a wild pod and went on a well deserved adventure.

    For the majority he was only a money maker for Dingle. They couldn’t give a rats about marine life as in other parts of Ireland and the world. The plunder of the seas will continue. Seals, seabirds and dolphins wil continue to be the unintended victims of human activity until they are no more.

    Some brutal comments above……he is the wildest of wild animals and could come and go as he likes.obviously he loved human contact some people just don’t get it… a magical creature so what if boatman made some money or there was a smell of diesel……have you seen the dolphin hunting in the Pharos islands now that’s disturbing…….

    @David cotter: Doesn’t suit the narrative of the eco-warrior types to admit that the dolphin appeared happy in Dingle Bay. They met him or went out to interact with him because they are in tune with nature. Everyone else just chased him around the bay for their own greedy pleasures. Pompous @rsehoIes.

    @Tommy Roche: Thankfully, finally, a decent comment, such misery and bitterness in the comments above. Whether you agree or not, he stayed for almost 40 years, he was a wild dolphin, could have left at any point but didn’t, so I will presume he was happy there

    Bottlenose dolphins have a lifespan of 40-50 years and considering Fungi was kicking around in Dingle for 37 years the likelihood is that he just died of old age. Joining a wild pod doesn’t seem plausible given his pronounced solitary tendencies – i would guess that he was an outcast from his own kind and could even have been reared in captivity originally which would explain his affinity for humans.

    @Sean: the idea that he had been held captive originally had also crossed my mind for the same reason! Nice to think perhaps he got the best of both worlds in his 37 years in Dingle, the human contact he perhaps knew and sought and living wild as he should have

    We visited Dingle and Fungi 2 years ago and to be honest I don’t know how Fungie a wild creature of the sea put up with it all for so long,its ironic that those same fishermen only exist because they take the Dolphins staple diet from the sea,huge swaths of which are now lying empty and devoid of fish because we agreed to let hundreds of EU boats fish in our territorial waters.

    @Richard Mccarthy: I disagree. The fish would be taken anyway. If the Spanish or Dutch didnt do it we would. It would probably be worse if us irish were in charge of the ocean. If would be wrecked more than it is now. EU laws facilitate slow death of the ocean rather than instant death. The problem is ourselves. We condone all environmentally destructive practices by buying the produce.

    @TheITGuy: If humans would finally use the brains they’ve been given, they would understand that the way they eat, has to change. And with it the industries around animal products. The fishing industry (no matter which country) is killing our oceans, and the livestock and dairy industry is killing our air and our health. The majority of people is still so heavily indoctrinated about the consumption of animal products, it’s amazing that they’re not still using stones to kill each other.

    And as to poor old Fungie, I’m also surprised he stayed as long as he did. There couldn’t have been much food out there for him, and the water pollution from all the tourist vessels and fishing boats must have been terrible for him. I sincerely hope he went off to find a nicer place.

    it was great to have the dolphin there…people who moan about kerry people and their economic relationship with it should note that trump has a hotel in the west and the locals would go mental if you criticized it…..i find trumps hotel more nauseating than the dolphin…..
