Level 3 enforcement: Taoiseach declines to give timeline on when fines could be introduced but says options will be discussed this week

The Covid sub-committee met this morning to discuss enforcement of Level 3 restrictions.

TAOISEACH MICHEÁl MARTIN has declined to give a timeline on when fines for Covid-19 breaches could be introduced, but said his government will assess options by the end of the week. 

Speaking this afternoon, Martin said that legislation is being looked at but that he hoped such measures wouldn’t have to be “relied upon”. 

The government is considering graduated fines for those who travel between counties for non-essential reasons and for other breaches of restrictions. 

As reported by TheJournal.ie this morning, the prospect of a graduated fines system, such as not wearing a face mask or leaving the county when restrictions are in place, was raised at the Fine Gael parliamentary party meeting last night.

One idea under consideration for graduated fines is a €50 on-the-spot fine for not wearing a face mask or leaving your county during restrictions. A spokesperson for the Tánaiste said:

“The law already provides for fines of €2,500 for breach of some laws like organising a gathering or not wearing a mask on public transport. All options are under review… but there are no plans at present for a new system of fines.”

Asked about the plans at the launch of the government’s new Climate Action Bill, the Taoiseach said the Cabinet Covid-19 Committee he chairs will be presented with options this week. 

“The review of existing legislation and existing regulations is now underway, the oversight group met this morning with a view to looking at introducing more graduated and proportionate fines for minor breaches of regulations,” he said.

I would expect that some options on that would be presented to the Cabinet Covid Committee meeting which is to be held on Friday. 

Asked when the fines could be in place, Martin said he wasn’t going to to give “any specific timelines on this”.

“I’m going to wait to see what will be presented to us and then we make a decision accordingly. And also will be guided by feedback as well,” he said. 

The Taoiseach also said that the government’s priority was to “work with people to build compliance without having to rely on those measures”.

It is understood that the government is concerned about the task of enforcement by gardaí given the high penalty, with a view that perhaps something smaller like a €20-€50 fine for leaving the county or not wearing a mask would work better.

Justice Minister Helen McEntee has also raised concerns about what what would happen if people refuse to pay fines.

It is understood the system is not likely to be rolled out any time soon, as it would require legislation.

Level 3 enforcement

Speaking in the Dáil today, Micheál Martin confirmed that the civil servant Covid sub-committee met this morning to discuss the enforcement of Level 3.

Martin said there are concerns about Northern Ireland, and that there “is clearly overspill” of cases from Northern Ireland into the Republic.

The Taoiseach says the subcommittee will meet on Friday and the government have asked NPHET about any additional measures, as ‘”we need to take to protect nursing homes, we are very concerned about it”.

The oversight committee is chaired by the State’s most senior civil servant, Secretary General to the Government Martin Fraser. It provides oversight to NPHET recommendations and their practical implications to society and the economy.

The Taoiseach also told the Dáil that the government expect to see a surge in the number of people applying for the Pandemic Unemployment Payment (PUP).

He said they expect that between 50,000 to 60,000 people will apply for the social welfare payment by Friday as a result of the country going into Level 3.

He said as of last night, 17,000 additional applications had been received.

Martin also told the Dáil today that he met the Chief Medical Officer Tony Holohan this morning. The meeting follows Monday’s controversy where the government rejected his advice to move to Level 5.

Varadkar also publicly criticised the CMO for the rationale behind his recommendations.

The Taoiseach said he had a good discussion with Holohan and he commended him for his commitment to the country and for coming back “to help the country”.

He said they both have a shared objective of getting the country through pandemic.

    @Seamus Hughes: That’s three scientists. out of hundreds that oppose their ideas. And they are basically suggesting herd immunity. Why can’t people like you just accept that for the majority of people who are compassionate; the cost of that approach is too high. It would end the lives of so many. There is no feasible way to shelter the vulnerable.

    @Paul Lanigan: Paul trying to balance the economy, the elderly, mental health and the virus is not an easy task. I think any educated person would acknowledge that.

    Love the way the state treats its citizens like bold children while those that make the laws get off scot free. This country works by who you know not doing favours and not by what you know.

    What we saw in Galway is exactly that. People have lost trust in the govt. Why would we trust them now.

    @David Lee: one side of the road between Lidl and the junction with Old Conna Road is in Dublin and the other side is in Wicklow. So you could drive into Lidl from north Bray suburbs but not drive home without breaking the law.

    With the breathtaking levels of inconsistency throughout from the government, the illogical approach to so many aspects of the restrictions and ill-thought out rules, inability to stick to their own published plan within two days and now the shambolic scenes with the checkpoints seen today, the government needs to rein themselves in and look at the whole approach again. The lack of buy in from the public to a large degree comes from the ineptitude of their leadership. Just throwing more jerking knees at it won’t help. They’ll just end up changing it next week. Clear thought and direction is needed.

    So fine healthy people for going against advice? I would be happy to pay the consequences if I was proven to have it and travelling around. But to say I am automatically putting others at risk because I go against advice is not acceptable. If I don’t have it I am not putting anyone at risk and will not except a fine until I am proved otherwise. And don’t give a response saying I could catch it by going against advice and then give it to others. I take all precautions when out and about.

    Just typical of our governments , Ban, Fine or Tax, their answer for everything, but only for the ‘little’ man . They need to control us , but not prevent us from being good little labour units and good little consumer units. God forbid that there is any forward thinking, like a plan for housing or health that goes beyond the next election date. God forbid there would be a long term investment in infrastructure . They are only interested in saving their place at the trough. I am so angry at all of this! If health is their number one concern, that is fine, but at least be consistent! If contact is the cause of the spread, then dont make people go to work unless absolutely essential, dont make the kids go to school, dont leave ferryports and airports open. If the economy is the number one concern, then that is fine too, but open it up properly and invest in extra protections for the vulnerable. This approach of cherry picking just isnt working. People mostly remain compliant, but are getting so fed up of mixed messages and inconstistencies that there is an anger and a fury building up. People are crying out for strong and fair leadership, and that is absolutely what we are not getting form our government

    About time! I’m so fed up of the whining about masks, number of people who can meet, etc. The majority of us are making the effort and the self obsessed princesses ignore all the advice. They do need to clarify what constitutes essential travel though. My two nearest supermarkets are in county Carlow and county Wexford but I’m in County Wicklow. Are we supposed to travel further from home because of a line on the map?

    If fines are to be levied the money should go straight to healthcare.
    I’m not advocating fines but there are a certain core of dead brains emerging calling everybody who wears a mask and takes precautions the “sheep or sheeple”.
    Well this “sheep” has elderly and immuno compromised people that he cares about.
    The next “enlightened” person that calls me a “sheep” to my face is getting a size 10 boot in the ball bag!

    They will need to present evidence that masks stop people dying or getting sick they have not yet done this yet and the previous 15 year there has been none evidence mask stop viruses.
    Imagine if there was evidence that shutdowns stop deaths from viruses, we could then shutdown and stop all deaths from viruses so why did no one think of this before SARS CoV2!

    Although I believe that we are in complete control of how we act now. Its up to each and every one of us to take responsibility for how the out come of all this ends.. however these roads blocks are causing hundreds of thousands in lost earnings for the working men and woman of this country. Every haulage company felt nothing but pain today sitting for hours at this checkpoints that aew useless because the guards have no power to enforce the law. Why would the government even consider dumping more fines on the working class men and women that are already struggling with reduculous taxes and paying the likes of denis o brien and his cronnies compensation for losses when non of them big corporate companies pay any corporate taxes. Boils my blood…..

    So, I have tickets for the Zoo in Dublin and live in another country. Technically I’m still allowed to travel or is it not allowed?

    @Vanessa: unless you’re an escaped resident of the Zoo I seriously doubt that a day trip to one of the country’s tourist hotspots will constitute an essential journey. Look for your money back I’d say.
