Stay granted to inmate set to be first woman executed by US in decades

Lisa Montgomery killed a pregnant woman in order to steal her foetus in 2004.

A JUDGE HAS granted a stay of execution to Lisa Montgomery, who was today set to be the first female inmate executed by the US federal government in 70 years.

Montgomery (52) has been imprisoned for 16 years after she killed a pregnant woman in order to steal her foetus.

She was scheduled to receive a lethal injection this evening at a federal penitentiary in Terre-Haute, Indiana.

But Judge James Hanlon of the Southern District of Indiana granted her an eleventh-hour delay in carrying out the court order yesterday. 

Montgomery’s lawyers had argued she was too mentally incompetent to be executed, and said she had been born brain-damaged and endured a life of extreme abuse before committing her crime.

“The record before the Court contains ample evidence that Ms. Montgomery’s current mental state is so divorced from reality that she cannot rationally understand the government’s rationale for her execution,” Judge Hanlon wrote in his ruling.

“‘Both the [government] and the victims of crime have an important interest in the timely enforcement of a sentence,’” he said, citing precedent.

But “it is also in the public interest to ensure that the government does not execute a prisoner who due to her mental condition ‘cannot appreciate the meaning of a community’s judgment.’”

Hanlon said the court will set a time and date for a competency hearing for Montgomery.

In 2004, unable to have a child, Montgomery carefully identified her pregnant victim – 23-year-old dog breeder Bobbie Jo Stinnett – online.

Under the guise of buying a puppy, Montgomery went to Stinnett’s home, where she strangled her to death and cut the baby from her body. She left Stinnett dead in a pool of blood.

In 2007, she was convicted of kidnapping resulting in death and handed a death sentence.

She would have been the first woman executed by the federal justice system since 1953.

Without denying the seriousness of her crime, Montgomery’s lawyers last week sought clemency from US President Donald Trump.

But Trump, an outspoken supporter of the death penalty, has so far failed to act on their request.

Despite the decline of capital punishment in the US and around the world, Trump’s administration resumed federal executions in July after a 17-year hiatus and has been carrying them out at an unprecedented rate ever since.

Since the summer, 10 Americans have died by lethal injection at Terre-Haute. In addition to Montgomery, two men are scheduled for federal execution this week.

Montgomery may escape the death penalty entirely, as President-elect Joe Biden – due to be sworn into office on 20 January – opposes capital punishment.

The Democrat has promised to work with Congress to try and abolish the death penalty altogether.

Montgomery’s execution has been postponed once before: after her lawyers tested positive for Covid-19 in November, a court postponed her execution until at least 31 December.

    It amazing, Hugh O’Connell , that you can quote Mairiea Cahill on a whim , but should we raise the connection between the Government Parties FG – Lab. / FF etc and she and the absolute admission by her, that she is an active Dissident , who is campaigning to break the Good Friday Agreement, by assisting in such means – such reasonable comment is often removed by you, as Editor .

    And what has that got to with anything Charlie? Doesn’t matter who has which post, they are part of the government and if they had any gumption or the slightest sense of loyalty to those that elected them we would have had a GE in 2012. They are as weak and ineffectual as the Greens were and they will meet the same fate come 2016.

    Dermot. I am not a supporter of the Labour party. Just because I point out the policies of a olitical party that I like does not mean that some of the decisions they have taken really tick me off.     €15 Million Pension bill for Labour Ministers (Sindo today). No wonder they want us to pay for water charges! It’s great how iso getting a higher pension if ur a Minister you get 2 pensions. One td’s pension and another ministerial pension! Near on €100k pension per year, that’s a pension of €2000 per week!! + €130k tax free lump sums. And not 1 but 2 termination payments. Unreal.

    Paul, we pay so much tax already we cant afford to pay for a pension. The cost of these politicians exhorbitant pensions costs many times the actual payout and we have to pay for it and now the want to impoverish us further w/ more tax in the form of water charges. This society has become extremely unequal. I’d love to hear Labour justify a pension of €2000 per week.

    Didn’t see them mention that retirees, Rabbitte, Quinn and Gilmore will get €2 MILLION EACH as their pensions despite this government still not honouring the Waterford Crystal pensioners and robbing 60% off Aer Lingus/DAA deferred pensioners to name but 2 and that’s not counting the €300 MILLION they ” borrowed” from the Pension Fund.

    I think to say that the anger over water charges has subsided is to grossly underestimate the mass non compliance that’s approaching in relation to paying the bill; the only thing we need to know about the Labour Party is that they are finished so their day of back patting and cuddles was a waste of time.

    Their poll numbers are on 6%. That means 94% of the citizens of this country do not want them in power.     People should stop picking on Labour. We did not give them sufficient a mandate to enable them to have policies implemented. If anything people should be picking on FG. They are the largest party in government.
    Come the next election we will decide who should be the governing coalition. However voters will only have the usual selection of parties to vote for.
    A certain amount of revenue must be collected in order to keep the country running. No matter who forms the new government we will have to pay one way or another.
    When FG said no new increase in taxes they simply replaced this with a plethora of levies and charges. The next crowd in will probably do away with some of these levies and charges but will simply replace them with other taxes.
    Different solutions same result for the ordinary citizen.
    No real choice.

    The argument that being the minority party in the coalition has left Labour powerless to prevent FG from forcing their agenda through might have held water if they had been seen to resist and at least attempt to block them. In fact, the opposite has been true – FG and Labour have consistently presented a united front on everything, and as such Labour have lost much of their support.
