    Comparing paedophilia to homosexuality is just completely wrong. Adults can consent to sexual activity, children can NEVER do this. Watching images is not a victimless crime – each child involved was abused and is a victim. 7,000 images equates to a LOT of victims. Without demand for these images, such as from that civil servant, the industry of child porn would not exist. So this man abused up to 7,000 children Himself. A suspended sentence is an absolute disgrace and while I think judges should be protected , it’s clear this judge has a warped view of what’s right or wrong and this needs to be highlighted.

    It doesn’t matter whether he paid for them or not. There’s absolutely no way you can download that volume of images by accident. An accident could be 1 or two which I would imagine any right minded person would immediately delete, not save on their computer.

    The guy was found with 7 thousand images on his computer… we don’t know the full story of the case… did he download them? Did his son download them? Was it by accident etc… everyone here is jumping to conclusions that he’s guilty without knowing the full story…

    The fact is, he was found guilty in a court of law. The problem is the lenient (pretty much non existent )sentence.
    People are abusing children as there’s a demand for this sick material.

    jgrcb. He was found guilty. If he had “innocently” downloaded those images in one file it would have shown in the evidence and he would have been cleared. But that he was found guilty shows that he knowingly downloaded those images.

    That is the most ignorant comment I have ever seen on the journal. Do you realise that there is a victim for every one of those 7000 images. A rape or indecent assault has taken place on the children in those images. By buying those images he commissioned a crime. Would you think it was ok to stand around in the same room and watch a child being raped and pay as you pleasure yourself as a child is being traumatised for life. Just because the child is halfway around the world and maybe a different race does not make it less real. I think people think these images are acting etc that is not the case. Everytime someone pays for child pornography they are creating a financial incentive for a child to be exploited and raped somewhere in the world. aWhilst I agree a petition will make no different and the judiciary must be independent they need more training on child abuse and its devastating effect.

    This guy is the tip of the iceberg our courts are a sham they are supposed to be the pillar of democracy where they are just and judges operate with out fear or favour ,well many of us who have been burned by the criminals who operate in our courts know they real truth and these people are still allowed to police themselves.the current system is the single biggest threat to what little democracy we have left and anybody who trumps the current system is benefiting in some way .

    This is not the first time Judge Nolan has handed down light sentencing for theses crimes. I often wonder do judges become immune to the effects of crime when hearing it day after day. Does it become a tedious job and should they be replaced on a regular basis.

    An individual’s outlook on life is bound to influence their decisions. We’re not computers.

    Though the sentence was very disturbing, as his previous sentences have been disturbing too, I think judges should have to justify their decisions somewhat rather than replacing them because we don’t like a sentence handed down.

    It’s not at all uncommon to see court reports in local newspapers where one guy gets a 6 month sentence for assaulting a guy and breaking his jaw, and the next day with a different judge the same scenario is presented and the guy walks away with a suspended sentence – a slap on the wrist.

    According to the court records he did not pay for any of the images
    We do seem to be getting into into a mob mentality been driven by the frenzy of radio talk shows such as #liveline and #Neilboylantonight to name but a few.
    I know very little about this case but I do tend to leave it to the professionals who are actually in court and know the full details to decide . putting sick people like this man into prison at a cost of a couple of grand a week is not always the answer and is rarely beneficial to these type of people or the victims

    I agree to some degree Jerry. He’ll also likely be targeted in prison a a sex offender – a sex offender that didn’t actually have sex in the first pace.

    I’m not going to try to justify his actions, I don’t have any justification, but it’s not as if he himself went out and sodomised a child, unlike many other offenders in this country.

    In fairness, I don’t know how someone could download over 7000 images “by accident” I’m sure the images would be at least 1mb depending on res, and 7000 of them would take a fair bit of room. it would possibly take a bit of work to get them too they are hardly in the top of pirate bays list of torrents. It’s discussing to think these people are getting way with it so lightly and then you have people in jail for doing small things in comparison. Were the hell is the logic?

    It doesn’t matter if he paid for them or not. Those children suffered so he, and others like him, could feed his depravity. They’re paying for his boners, with mental and emotional scars, with physical scars, with (in some cases probably not all though) the knowledge that people out there are wanking to their childhood nightmare.

    His paying, or not, financially is irrelevant. He consumed this “product”, a product made from the suffering of children.

    THAT makes him just as wrong, just as abusive.

    As far as I know the owner of a pc doesn’t have to take responsibility (legally speaking) and the financial transaction aspect is actually quite important. Remember this is a criminal case, so although the balance of probability would indicate his guilt, it must be shown beyond a reasonable doubt that he downloaded the images, and not that they were downloaded on his computer by someone else. This sentence could possibly be due to the judge being worried about the safety of the conviction, but by handing down a lenient sentence a conviction is secured while the chance of the defendant pursing an appeal are reduced as his sentence could be increased on appeal.
    May be more to the story than can fit into a short journal article.

    Even if he had deleted all the images, the forensic software available today could retrieve most of them unless the user new about and had used other forensic software to erase their existence on the hard disk. In this case we are not told if the images had indeed been deleted and the accused might have thought they were gone for good.

    7000 is alot but sure what if its an archive he downloaded via a torrent site. One click just wait and 7000 images there you go. Technically someone could do it by accident some searching for regular porn its mislabelled and you think your downloading something you like but its illegal images. Now I know not in the above case but just saying its completely possible.

    Just from being tech savvy the ways they are nabbed are either going to a site with underage stuff REPEATEDLY not just once by mistake and traffic through the server is being monitored. Paying for images via card and transactions monitored.     This judge, Judge Martin Nolan is the same judge in the Anglo banking trial (community service), the same judge in the garlic trial (6 years jail to a farmer) and now this (as well as other questionable sexual cases), god knows what emotional damage.

    Mandatory sentencing does exist for certain crimes, but there has to be a level of discretion involved too.

    You wouldn’t sentence a severely ill 80 year old in a wheelchair to life in jail via a mandatory sentence.

    I have to admit that the sentencing approaches of this particular Judge make me feel distinctly uneasy.

    The possible leniency of sentencing in this can be appealed and reviewed. Hopefully, that will happen.

    Petitions, however genuinely intended, may be counter productive. The judiciary likes to show that it will not be swayed by public opinion.

    I suggest that we await the outcome of the almost inevitable appeal by the DPP.

    maybe it is time for the judges to learn that they are not gods after all. Who pays their salaries? Who are they answerable to? Judges of course are mere bankers for the corporation.     ”The constitution guarantees judiciary independence”, presumably that independence refers to independence from political interference. I don’t think anyone criticising his sentencing is suggesting or supporting political interference of any sort. However, surely a judge has to take the interests of the public into account with regards to sentencing, i.e considering the deterrent factor to others. It seems odd to suggest that judges could act completely in a vacuum and not factor public interest into their sentencing.

    Don’t know why people are red-thumbing you there Birch, you’re just stating the facts. If people want laws and sentences changed, then the mechanism is through their elected representatives. Judges should never have to listen to public opinion, only hear the facts of the case and interpret the law of the land as it stands. Otherwise we’d be seeing public hangings every other week.

    That doesn’t mean I don’t agree entirely that Nolan’s sentencing is and has been a joke, and every practical effort should be made to prevent this nonsense in future. This is not a victimless crime, as he clearly believes it is.

    It does seem odd, Eoin, that the judge can seemingly do what he wants with impunity, but if the alternative is a popularity contest, with judges being elected, like they do in the US, then I’d rather stay with our system. But there should at least be some kind of review at set intervals where a judge’s peers and some kind of law commission would look at their judgements over a period of time and determine whether or not they are doing their job properly. Every job has to have the possibility of answerability and review.

    What sucks is the judgement of those who promote guys like this to the judiciary in the first place.

    Judge Nolan’s sentencing on these cases has caused massive controversy but you’ve attributed a case to him that he didn’t rule on. The first case you mention was a Central Criminal Court rape case. Judge Nolan is a circuit court judge. That case was well reported. It might be wise to check the details.

    To think that the police randomly spot checked this individuals PC and lo and behd 7k images on it by accident resulting in arrest??? Really?     There should be a panel of senior judges (like the medical council) who perhaps are elected by all judges who can on their own initiative or on instructions from a minister look, into a sentence and if necessary overturn the sentence and instruct the judge that his sentence policies are not acceptable. If there are enough bad judgements from a judge then this panel should be able to fire a judge. There have been several judges in Ireland and the UK who had a string of poor sentence decisions made over the years and nothing could be done about them.

    He got away with nothing! Suspended 3 and a half year term – put a foot wrong and his prison term is activated. 18 months reporting to dept justice ibliged to follow all lawful directions, and 5 years on a sex offenders register that places serious incursions on his freedom of movement. This was not a lenient sentence for a first offender with no record who’d pleaded guilty, cooperated with authorities and shown genuine remorse.

    Judge Nolan made an informed rational sentencing disposition, following his engaging in a proper sentencing exercise.

    We already have one Judge in prison. Remember Heather Perrin?? Judges are completely subject to the ‘absolute power corrupts, absolutely’ factor.     Can we all agree that “Judges have to be independent for the justice system to work.”?

    Can we also agree this should not allow Judges hand down lenient sentences willy nelly?

    Can we then agree that where Judges continue to hand out lenient sentences, for particular types of convictions where the state continually appeals the lenient sentences handed down that Judge that the Chief Justices of the Courts examine the sentencing practices of that Judge. After all if the state is continually appealing and winning against the sentencing practices of a particular judge relating to particular types of crimes, would their not be a case for examining the Judges fitness to practice based on wastage of public money alone?

    I think the problem with sentencing is that the law is the wrong way around. Offenses carry a maximum sentence and the judge works down from that. It would be better if offenses carried a minimum sentence and judges worked up from that.

    The DPP will have the best understanding of this case. They are the ones to seek that it is sent forward on appeal. This is the proper way for this to be dealt with. If DPP doesn’t we must assume that judge got it right on this occasion.

    The biggest problem with our Judiciary is that they are accountable to nobody. There needs to be an independent ombudsman that can bring Judges to account. And if necessary remove them from office. The case of the judge caught with the pedophile images on his computer springs to mind.

    The law along with this judge in particular is an ass . Our courts,judges and sentencing are so removed from reality it is shocking and surreal at times. Life for taking a life (1st degree murder),should mean life,rape on any person or sexual assaults on children should carry a minimum 30 yrs,armed robbery or serious assaults a minimum of 25 yrs ,drug dealing or possession of an illegal firearm a minimum of 25 yrs and this particular crime which is heinous a minimum of 25 yrs. Lets see how many people would think twice if they knew they would get the above mandatory sentencing for the said crimes.

    Here I was thinking that the law itself is derived from the will of the people, a fact that arrogant insiders like “unnamed legal professional” fail to remember. A system without oversight is automatically doomed to failure.
    A number of years ago I was involved in a discussion with a law student, they argued that Joe O’Reilly shouldn’t have been found guilty under the law as it stood. I agreed in theory, but the law and the system that implements it has become warped. In the real world, hanging would be too good for Joe.

    Whether he paid for them or not is irrelevant. Its an offence to download then and to have possession of them. Its not a case of how it happened anyway, the fact is he was already found guilty.
    I know that Child porn is rated on different levels when it comes to sentencing. And obviously the worse the images the longer the sentence. So you could say that if they were at the lower end of the scale then under current sentencing rules a suspended sentence was justifiable. However 7000 images is beyond justifiable! He should have gotten a custodial sentence. It sends the wrong message out to others.

    Collectivism holds that the individual has no rights, that his life and work belong to the group (to “society,” to the tribe, the state, the nation) and that the group may sacrifice him at its own whim to its own interests. The only way to implement a doctrine of that kind is by means of brute force — and statism has always been the political corollary of collectivism

    Collectivism is a concept that the power of society is unlimited. Society may make any laws it wishes, and force them upon anyone in any manner it wishes.
    In other-words you only exist to serve the state and embrace ideologies that monopolies and monopolists like Dennis O Brien serve the state at the expense of people’s rights to self-determination.
    Total control of the natural resource owned by the people is Collectivism in force and must be resisted.
    “We the People hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.
    That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness.”
    If this Government won’t hear the voice of the people, then let them feel their power. When tyranny raises its ugly head, then it can be and must be resisted with whatever force is necessary, be it the spoken word or alternative dimensions.

    Judges cannot bow to the will of popular opinion, but they themselves can surely be judged by their peers. A board of supreme court judges and retired judges should be established to examine potential instances of favouritism or misjudgement.
