Newspaper licensing body issues statement on "paying for links"

Newspaper Licensing Ireland has issued a 64-word statement on its position on paying for links following much discussion online.

THE ORGANISATION WHICH collects money from websites which it says breaks copyright by linking to Irish newspapers has issued a statement on its position following much discussion online.

In a 64-word statement posted on its website, Newspaper Licensing Ireland set out its stance on charging for links, saying:

For personal use: NLI never requires or requests a licence for personal use of newspaper content.
For commercial use: NLI does not require a licence from any organisation which only displays or transmits links to newspaper content. A licence is required when there is other reproduction of the newspaper content, such as display of PDFs or text extracts.

The statement appears to contradict information which was sent to charity Women’s Aid in 2012 by NLI. Solicitor Simon McGarr published extracts from correspondence sent to the charity which stated that:

A licence is required to link directly to an online article even without uploading any of the content directly onto your own website.

The NLI is a subsidiary of National Newspapers of Ireland, which represents 16 national newspapers and 25 local and regional newspapers across Ireland.

Today’s NLI statement echoes comments made by the NNI on Friday, when the newspaper body said that “copying activity” which would require payment included reproducing an extract from an article or the full text of the article along with the link.

The NNI also asserts that a hyperlink from one website to another can constitute copyright infringement.

The majority of Irish newspapers have not commented on the ongoing situation.  However the Irish Times has said that it is in favour of people linking to its site.

In an opinion piece today, the newspaper’s Chief Innovation Officer Johnny Ryan said the issue for the Irish Times is one of reproduction of content rather than linking:

A clear separation of the benign issue of “linking to” content from the more fraught issue of “reproduction of” content is required to allow the copyright debate to proceed on the correct footing.

    … they use the threat of terror to strike first at potential terrorists! Kind of like a kid going around the playground with a big stick, beating any kid he doesn’t like the look of, any kid he feels threatened by, any kid who doesn’t play the game HIS way & threatening all other kids with a beating if they don’t tell on other kids!
    And then he wonders why no-one in the school likes him … !?

    As was said in the article, they already discovered bugs before Snowden released any information. Snowden just helped the EU uncover even more. The US can say all they want about the “fight against terrorism” but what the hell does the EU mission to the UN have to do with it? The NSA is out of control.

    I don’t mind them spying on the EU, all states do that kind of thing and always will. Its the private citizen information that they are collecting from all our communications thats really scary. Any country thats as paranoid to do something like that is no longer a real democracy.

    No wonder people don’t trust or like them the yanks like to portray themselves as the good guys but that is not the case and ed Snowden just showed the world that all they do is exploit the world it’s people and resources for their own good sorry guys but your not the world police and your not the greatest country in the world get your own house in order before you start telling other countries how to conduct their business

    The yank government and its security otganisation have become totally paranoid and cannot and should not be trusted in any way or form. Spying on alies who are no military threat bugging of eu and other allied nations eg UK is only for commercial reasons which should not be the role of security, just shows more of the yank govt desires to rule the world no matter what their politics are.

    @Peter The British GCHQ admitted to monitoring everything, phone, fax etc, (email wouldn’t have really taken off at the time) going in and out of Ireland up to 1995. Of course they no longer do that now…
    I’m beginning to feel left out with all this surveillance, they monitor everyone else but not me. Unless, oh crap…

    Anybody who carries out normal business over the Internet should be very concerned about this surveillance. We would be fools to believe that it is only legitimate security threats that are being monitored. Billions are made and lost everyday on stock exchanges and speculation, inside knowledge is a key part of the success of many of these speculators. Every powerful nation in the world is doing this, the only difference being the level of penetration and sophistication of their surveillance. If the US is spying on the EU it’s hardly for any other reason than commercial gain as the EU has no capacity or indeed proclivity towards terrorism. If the situation was reversed we would have the US demanding the extradition and prosecution of the offender. What are the chances of the toothless EU demanding likewise?

    Christopher Tappin is one name that comes to mind as he was extradited to the USA from the UK, there have been others too which I must check out, but the traffic is one -way as Obama/Soetoro amends US law to suit his ends.

    We can bang on all we like about the USA but the reality is that they hold the big stick in terms of military might and in our primate world he who thumps his chest the hardest is king. The US can and will do whatever it wants and there is nothing we can do.

    I suppose gingerman what I mean is that if we choose right over self-interest, then we will stand up against tyranny and injustice no matter what country, of whatever political complexion, is practising it on a grand scale… The effect of allies around the world combining to condemn and ostracise the US would indeed make a difference imho. But I know what you mean – it would not be an easy task…

    While you are correct, no nation can stand on its own no matter how big the stick. Collectively the military strength of the EU could compete with that of China, Russia and the US. If Russia were to mobilise its Cold War stocks then its military would certainly be larger and more powerful than the US.

    If the US keeps alienating the large powers of the world then they sure as hell won’t be swinging the biggest stick for very long.

    Russias cold war stock pile of nuclear weapons, perhaps? But its cold war arsenal was connected to the nations it essentially imprisoned, so they will never go back to Russias side, regardless. The russian military is rearming, yes, but it is no match for the United States, regardless of the spin its enemies and friends try to put on it, presumably to justify their own excessive military expenditure. Its equipment keeps failing, its soldiers are unbelievably undisciplined and the political agenda of its ruling elite has isolated the ruling regime from its former ‘comrades’ in eastern europe, most of whom look to the west for leadership now, as they are young, educated and mobile. Russia is a snake in the grass, capable of great cruelty, but the nuclear deterrent nullifies its ability to attack the US and its army is not capable of sustaining a confrontation anywhere.
    China is also rising, but its nowhere near the US yet. It is, literally, years ahead and capable of mass producing technology and weapons that could devastate their military, should the need arise.

    Its smaller population are poorer. It has a weak and aged military complex, with few allies and a discipline problem that beggars belief. And America designed our technology, and dominates military technological advances across the world, so saying they are ‘clever’ is great, but it is unsubstantiated nonsense. Im no fan of America, but reality is reality, regardless of how much some wish it wasnt

    You need to stop reading them stars and stripe books Kenneth. The US are notorious for stealing ideas from abroad and trying to better them only failing in the process. If you look at any top 10 military tech tables it always puts the abrams tank or the f35 top. The fact is the abrams is not top, it’s turbine engine is flawed, too much fuel consumption, little reliability and the fact it’s a sitting duck when the engine is damaged because all electronical systems run off its power, the German leopard is a vast improvement on the abrams, even the T90 is more battle hardened and effective in ground assault. And according to the yanks, the f35 is the world’s greatest fighter jets. It’s not, plagued with problems including vector trust issues that can cause it to fall from the sky. The harrier has been doing that job for over 20 years and even with BAE systems behind them it was still flawed. F16 and f15 are great examples of military tech but if you ask me the su27/35 are amazing still to this day and in the right hands are easily ranked as one of the greats, sure look at how long it took to beat the migs records.

    How many things in your home are Russian? I was responding to a remark that said russia was better, which it simply isnt. I have never read stars and stripes, and consciously finding little snippets of military personalised opinion to counter my general statement doesnt change anything. The US is miles ahead of any of the other military powers. Do you think they are not?

    The current president has been a real disappointment. Il still maintain my view that the last real president despite his faults was JFK. He stood up to the military industrial complex and paid the ultimate price.

    Hi all. You know know America is a great country but its government is very suspect. A lot of people over the past few months have lambasted US citizens right to bear arms….many of whom see it as their right to have that against a possible tyrannical government should the time ever come…..would you blame them?
    Many call Alex jones crazy which he is in many ways but some of what he says has actually proven to be correct. I am surprised the journal has not reported on the death of Rolling Stones journalist Michael hastings – very suspect indeed

    I mentioned Michael Hastings several times in these comments but most people have never heard of him and his strange death has been ignored.
    If you mention Obama/Soetoro in an email or anything on the interweb it will be flagged up by the US spy machine so help them out by using this every time you post :-)

    I don’t know that I trust Alex Jones. I think if he didn’t already exsist the US security services would invent someone like him. He destroy’s the credibillity of all the stories he gets involved in. As soon as people hear that the name Alex Jones is connected with something, people switch off.

    Its like if the main stream media is interviewing someone who is asking questions of what happened on 9/11 the interviewer will often mention words like conspiracy theory or aliens just to get the public to associate questioning the offical 9/11 story with the word conspiracy theory or aliens so people will switch off, next time people hear someone question 9/11 the word connection kicks in and the person thinks that people who even question the offical 9/11 are nuts. The name Alex Jones also works as a similar method to descredit news items.

    @ Martin I am very curious as to what Snowdens documents can reveal about 9/11 or the extent that USA are working in collaboration with Al Qaeda, like they done with the Taliban in the 70s .and today in Libya and Syria.The spying on German industry does not come as a surprise considering their technical advantage in many areas. It could be useful to a paranoid and rapidly falling empire. This is not to mention the insight to the EU banking system and the possibility of manipulation. Libor index etc.

    Another crazy campaign of spying by one of the most paranoid countries in the world. Instead they could be doing something useful like spying on Bank executives and getting the real low down of what is going on behind the scenes. That would be a more useful use of there spying capabilities

    They know exactly waht thre Banks are doing – heck the banks put the US govt in power – and Jamie Dimon and Obama are bosom buddies .
    US govt may be the biggest Terrorists on planet – but they are not stupid . As for US population and most populations – it is the job now of Goverments to keep them in fear – and by and large it is working- they are the ones that are stupid or scared – and this NSA thing may acually help that – ie put more fear into scared populations – best forget about it – and carry on – hello Mr Cai man – u at the computers – have a good day . .
    The Arab spring put Morsi – a US stooge in power – but if we learn from those in Barzil and Turkey- we may get somewhere – - these so called democratic govremnets that have treated the people like garbage need to be thriown out – physically

    Did anyone know that the CIA are not meant to operate within the United States but actually do. There is an excellent series on RTE at the minute called person of interest…..the worry is that the programme is probably not far of the truth

    If you are actively being spied on by the US, why would France, Germany etc remain part of NATO. Cold War is over in so far as Russia don’t pose the threat they did, but having its allies leaving NATO would be a massive kick in the teeth for the US and bound to force them to change their attitude
